On December 30 of last year, the investigative show "Stop" on TV Klan, broadcast the complaint of Mrs. Majlinda Kola, who in 2018 bought a 2+1 apartment, with an area of 107 m2, from Albana Mylyshi.
The sales contract was made by notary Vitore Biba. In that same year, Majlinda was provided with a property certificate and the property was unblocked. But when Majlinda wanted to sell the apartment, it turned out to be blocked, as it was confused by the Cadastre with the entry of the neighbor.
"I bought a 107 m2 apartment in 2018, I did the notary, I got the ownership certificate. I want to sell the house. I went to the notary, she said you have to go to the Mortgage to get it because the house is foreclosed. I have not received any kind of loan. Nothing. They mixed up the property numbers in the Cadastre and my house belongs to Agustin Bardhoku, the neighbor. First, I went to the notary to update the assets. There I discovered that the house is foreclosed and I cannot sell it. When I went to Cadastre, the director Klajdi Dodaj told me that a mistake was made by the former first director Jul Përgega. We are suffering this thing that I can't sell the house. Even when there was another director, I went and complained, we did all the things and he left, this other one came, you have the answer here on paper, but he couldn't solve anything". says Majlinda Kola.
The chief registrar of the Cadastre in Lezhë, Gentian Malotaj, promised to set up a working group to solve this problem.
"We will set up a working group to verify the issue of the file, with the two best lawyers we have and an engineer, then we will normally provide the requested service to the citizen. To the citizen, as long as he has a property certificate, we must definitely give him a solution", said the director of the Lezha Cadastre, Gentian Malotaj.
Although a solution was promised, this did not happen and the citizen Majlida Kola gave an answer, where it is said that the citizen should solve the case himself, not the Cadastre that made the mistake.
Complainant: After the interest of the "Stop" show, Lezha set up the inspection group and I received this answer from the Mirdita Land Registry:
The agency is not responsible for errors in notarial acts related between private entities. At the same time, the local office of ASHK Mirdita is not before the correction of the error resolved as a result of material errors during the registration of acts. For the specific case, we are in front of administrative and notarial acts drawn up by third parties. The correction must be carried out by the parties or through the express will of the parties, with whom the registration brought legal consequences.
For this case, "Stop" turned to the Cadastre of Rreshen, where Klajdi Doda said that a mistake was made in the data entry and the lady's property is blocked.

Julian Përgega: Në dijeninë time, shkresa i është drejtuar Urbanistikës, BKT-së, shoqërisë. Një kopje e shkresës shihet ajo, nëse ka shkresë që i është drejtuar.
