The Constitutional Court has rejected the appeal of Pëllumb Gjoka, who requested the return of properties seized by the Special Prosecution Office (SPAK) within the framework of the "Metamorphosis" case.
The businessman has had 390,000 meters of land on Velipoja beach seized at the request of SPAK, as it is suspected that these areas were obtained through forgery.
Pëllumb Gjoka is also known as the owner of a number of properties and facilities with a service, hotel or gambling function, but which were not included in the seizure.
Kolë Gjoka and the "Imperial Group" company claim that the 390,000 square meters of land on Velipoja beach is in their name and not the businessman's.
Despite the claims of the Imperial Group company and two citizens Kolë and Pëllumb Gjoka, who considered the seizure unconstitutional, the judges of the Constitutional Court have considered that the decisions of the lower courts should remain in force.
Previously, the Constitutional Court also dismissed Pëllumb Gjoka's lawsuit, which questioned the validity of receiving and using messages from "Sky Ecc" in criminal proceedings in Albania.
Businessman Pëllumb Gjoka was arrested on July 27, 2023, based on an investigation conducted by SPAK. Along with Pëllumb Gjoka, the prosecutor of Kukës, Xhevahir Lita, the former chief of operations of the State Police, Oltion Bistri, and other characters from the black chronicle in the Shkodra area were also arrested.
They are accused of being part of a criminal group and face various charges, including murder, providing the conditions and means to commit murder, corruption, abuse of office, money laundering, and others.
The investigation into this group of people began after SPAK received from French and Belgian authorities the decrypted data from the Sky and Enchrochat applications.
According to SPAK, Pëllumb Gjoka appears to have communicated via messages with members of the Bajri tribe in Shkodra about carrying out assassinations, including payments for executioners and financing for the purchase of weapons.
