Today, the Constitutional Court continues the hearing for the review of the request of the head of the Democratic Party, Sali Berisha, who seeks the annulment of the decisions of the GJKKO and the Appeal of the GJKKO that have imposed the security measure of "house arrest" on him. The hearing started on October 19, but was postponed until today.
The head of the democratic party demands freedom on the grounds that the decision was given in violation of the Constitution, because the Assembly was avoided since he is a member of parliament.
Since December 30, 2023, Sali Berisha has been under the security measure of "house arrest" for the "Partizani" case, while even earlier, his requests for release were rejected by the judiciary.
"Repeal of decisions No. 112, dated 20.10.2023 and No. 117, dated 26.10.2023, of the Special Court for Corruption and Organized Crime; No. 56 (87-2023-156), dated 21.11.2023 of the Special Court of Appeal for Corruption and Organized Crime; No. 00-2024-384, dated 05.03.2024 of the Criminal College of the Supreme Court ," says Sali Berisha's request.
With the decision on Berisha's request, the Constitutional Court sets precedents as to whether authorization from the Assembly will be required for such measures or not.
