The money of the 130 million euro laboratory concession continues to fly to the Netherlands, in the hands of the Greek tycoon Konstantinos Karathanos, the son of Jani Karathanos, the beneficiary on paper of the concession. While SPAK has in its hands since January 2022 a criminal report of the Supreme State Audit, which referred to the highest investigative body the file of the concession of the laboratories of the university, regional and municipal hospitals of Saranda and Lushnja, as a corrupt and illegal concession.
In the KLSH report, concrete violations are referred to, which have dictated the winner of this service, in violation of the law, violating equality in tenders, in order to channel and share the money with the beneficiaries of the concession.
If in the case of Arben Ahmetaj, SPAK was appreciated for the intensity and depth of investigative actions, by closing within a few months a corruption file similar to the files of the FBI, in the case of the laboratory concession, the opposite has happened.
It seems that the prosecutor of the case has 'forgotten' this file with many compromising elements for the former Minister of Health, Ogerta Manastirliu and the beneficiary of public money papers, Jani Karathanos, behind whom there may be oligarchs and politicians bent on corrupt affairs.
The history of the corrupt concession
On July 23, 2019, the LABORATORY NETWORKS company was registered in Tirana, with a capital of 10 million lek, which would implement the concession contract worth 130 million euros for the medical analysis laboratories near the university, regional and municipal hospitals of Saranda and Lushnje.
The implementation company was founded in June 2019, registered in July, while the Ministry of Health had signed the contract in April 2019 with the merger of the three companies that won the concession.
The company is owned by three companies located in Albania, Holland and France.
The first is LABOPHARMA LLC, founded in 2007 by Greek citizens Ioannis Xopapas and Janis Karathano.
The company Labopharma, filed for non-payment of tax obligations and having a license to sell drugs, has 41.7% of the shares, thus of the laboratory concession.
Today, the owners of Laboparma are Janis Karathano with 50% of the shares and T-MEDSS company with 50% of the shares.
The owner of T-MEDSS, a shell company founded in 2021, is Sokol Ramizi.
Sokol Ramizi is also the administrator of the laboratory concession.
Sokol Ramizi, through T-Medis, is a shareholder in the Megapharma company of Rasim Hamzaraj, known as Petri Vasili's uncle.
Concession money to the Netherlands
Kompania e dytë e koncensionit të laboratorëve është AB Laboratory Solutions B.V, kapital 2.1 milionë lekë, me adresë në Laan Van Meerdervoort 1224, 2555 CD Hague, Hollandë, e cila ka 33 % të aksioneve në kompaninë koncensionare të laboratorëve.
Kompania është themeluar në vitin 2007 dhe nuk ka asnjë lidhje me laboratorët dhe diagnostikimin, por ka si objekt veprimtari financiare.
Kjo kompani, me administrator Konstantinos Karathanos, është në pronësi të kompanisë shqiptare Pegasus, me pronar të vetëm Janis Karathano, me të cilën ka marrë mbi 100 tendera në shëndetësi me vlerë rreth 20 milionë euro. Konstantinos Karathanos është i biri i Janis Karathanos.
Më herët administratorë të kompanisë AB Laboratory Solutions B.V kanë qenë Orinoco Mining & Resources B.V, ITPS (Netherlands) B.V., Luisa Cinzia Ramasso dhe Alexandra Eleonora. ITPS ka administruar edhe kompani të tjera në Holandë, përfituese e koncensioneve në Shqipëri. Tre nga katër komcensionet në shëndetësi dyshohet se kontrollohen nga e njëjta dorë.
Gjithsesi, në letra Janis Karathano dhe Sokol Ramizi kontrollojnë në letra 75 % të koncensionit.
Karathano ka blerë dhe përdorur një kompani financiare në Holandë, për të krijuar idenë e një bashkimi ndërkombëtar shoqërish, duke fituar koncensionin 130 milionë euro.Kompani e tretë, e cila ka 25 % të koncensionit të laboratorëve, është EXALAB, një shoqëri franceze e regjistruar në Francë, me adresë në 208 Avenue Pasteur 33600 Pessac, Francë, dhe nr. regjistrimi 323 191 106 R.C.S Bordeaux.
Në të gjithë këtë kartel kompanish të sajuara dhe të ndërlidhura me Janis Karathanon, e vetmja kompani reale është shoqëria franceze EXALAB, me objekt laboratorët për analiza mjekësore, themeluar në vitin 1998, me administrator Olivier MARQ dhe Valérie MARAZANOF, me kapital 4.8 milionë euro.
Procedurat për koncensionin e laboratorëve nisën në vitin 2015 dhe u finalizuan në 2019 nga Ogerta Manastirliu. Kontrata u firmos në 10 prill 2019.
Në bazë të kontratës, spitalet i paguajnë konçesionarit tarifën e shërbimit për të gjitha analizat e kryera në bazë të rekomandimeve të mjekëve referues, gjithmonë pa tejkaluar tavanin e buxhetit.
Tavani është një buxhet mujor i caktuar për çdo spital për analizat, i cili nuk duhet tejkaluar.
Në fund të muajit maj të vitit 2022, pati një urdhër që të mos referonin analiza për pacientët e tyre, me përjashtim të rasteve tejet urgjente, pasi ishte prekur tavani për atë muaj.
Pra, kush pati fat, i bëri analizat, ndërsa të tjerët duhet t’i drejtoheshin privatit, edhe pse kanë paguar për vite me radhë sigurime shëndetësore.
Çështja penale
Në 31 janar të vitit 2022, SPAK ka regjistruar procedimin penal nr. 18 për veprat penale shkelja e barazisë së pjesmarrësve në tendera dhe ankande publike, shpërdorim detyre dhe korrupsion pasiv të personave që ushtrojnë funksione publike, në lidhje me koncensionin e laboratorit.
Hetimet nisën pas një kallëzimi penal të Kontrollit të Lartë të Shtetit, i cili auditoi gjatë vitit 2021 koncesionin e laboratorëve mjekësorë.
KLSH arriti në përfundimin se Ministria e Shëndetësisë e kishte dhënë koncensionin në kundërshtim me ligjin “Për Koncesionet dhe Partneritetin Publik Privat”, kallëzoi anëtarët e komisionit për dhënien e koncesionit si dhe i kërkoi zgjidhjen e kontratës.
Sipas KLSH-së, Koorporata Ndërkombëtare e Investimeve (IFC), pjesë e Bankës Botërore, kishte kërkuar skualifikimin e grupit të kompanive fituese, pasi njëra kompani shqiptare ishte në ndjekje penale në Spanjë.
Korporata Ndërkombëtare e Investimeve ka shprehur shqetësime serioze për integritetin e kompanisë së regjistruar në Holandë, AB Laboratory Solutions, e skeduar për mashtrim dhe krime financiare.
Gjitjashtu KLSH vlerësoi se AB Laboratory Solutions B.V u përdor si koracë për të mbuluar përqindjen reale të ndarjes së aksioneve në konsorcium. Ndarja ishte fiktive, pasi dy kompani në dukje të ndryshme, ishin faktikisht një, me pronar Janis Karathano.“..
Nëse do të ishte paraqitur vetë Pegasus si aksioner në konsorciumin e ngritur, atëherë pjesmarrja e tij rezulton 75% e aksioneve dhe jo ndarja që është paraqitur në marrëveshjen e konsorciumit…, ku natyrisht ndryshojnë edhe kushtet e vlerësimit, të cilat në shumicën e detyrimeve i takojnë atij për t’u përmbushur si nga ana ligjore dhe financiare,” thuhet në raportin e KLSH.
Ndërsa Laboratory Networks ka pretenduar se “Konsorciumi fitues, qartazi dhe në mënyrë evidente ka përmbushur në mënyrë strikte dhe ka tejkaluar të gjitha kërkesat teknike, financiare dhe ligjore dhe kriteret e garës në tërësi, dhe mbi të gjitha ajo është përzgjedhur pasi ka ofruar çmimin më të ulët në këtë garë…”.
Ndërsa, komisioni i koncensionit pranë Ministrisë së Shëndetësisë pretendon se informacioni për hetimin ndaj kompanisë ‘holandeze’ të Karathanos në Spanjë, nuk është i vërtetë.Të kallëzuar në SPAK janë Raimond Cimbi, ish-drejtor i Drejtorisë së Prokurimeve në Ministrinë e Shëndetësisë, i cili ka qenë kryetar i komisionit të dhënies së koncesionit.
Janë kallëzuar edhe 6 anëtarë të komisionit të dhënies së koncesionit, konkretisht Silva Novi, përgjegjëse e sektorit të Standardeve dhe Protokolleve Spitalore në ministri, Leonora Horanlliu, përgjegjëse e sektorit të Programimit dhe Monitorimit Buxhetit në FSDKSH, Ariola Krymi, mjeke koordinatore në Laboratorin Biokimik në QSUT, Anjeza Alliu, përgjegjëse e sektorit të Prokurimeve, Gazmir Vehbi ekonomist në Agjencinë e Trajtimit të Koncesioneve si dhe Armila Ali ekonomiste në Agjencinë e Trajtimit të Koncesioneve.

Hope Bello received 400 thousand USD from Karathano
It has been proven that only the former director of Pharmaceuticals at the Ministry of Health, Shpresa Bello, received hundreds of thousands of euros from drug oligarch Janis Karathano through her mother Nazife Bello. Shpresa Bello has no signature in this procedure, but the corruption investigation by SPAK has shown the way of money to public officials, even though the latter did not participate in the procedures for awarding concessions and tenders.
Shpresa Bello's mother, Nazife Bello, worked at Janis Karathano's company with a salary of about 1 million old lek per month.
After her daughter Shpresa Bello was appointed an important health director, Janis Karathanos suddenly increased Nazife Bello's salary from 1 million lek to 29 million lek per month.
What happened that Nazife Bello's salary increases from 1 million ALL to 29 million ALL on the eve of retirement?
Not only that. In addition to the salary that reaches the figure of over 350 million lek per year, Janis Karathano has given over 100,000 euros to Nazife Bello in just one year, for allegedly high performance at work.
In fact, Nazife Bello's 'performance' is the role of her daughter Shpresa Bello as an important health director.
For his part, Janis Karathano has found a way to give Shpresa Bello a part of the money obtained in a clientelistic and illegal manner. It is a more flagrant case than that of Alqi Bllakos.
There cannot be a more flagrant scheme of corruption. However, SPAK continues to sleep on this file.
