The President of the Constitutional Court, Holta Zaçaj, said on Monday that she did not provide information regarding some allegations that judges of this institution are being wiretapped by the Special Anti-Corruption Structure.
This issue was addressed on the show "Real Story", where criminal expert Ervin Karamuço said that if there is a report to SPAK from any of the members of the Constitutional Court about illegal influences that may have been exerted on them, then the conduct of the wiretapping cannot in any way be considered a constitutional coup, but simply a practice based on the law.
" The logical line and allusion to the specific case. We are not facing a constitutional coup. A constitutional coup would be to go to the Criminal Court without any evidence, without any information and keep everything under surveillance, like the secret police of the past. But if you have the papers there of a complaint, you have taken all the actions with the court to conduct investigative actions, everything is in accordance with the law. But where will this go? Will we have a measure for a member of a court, or will he be dismissed because there is no evidence from those who were reported by this member, if he is a member anyway ," he said.
He added that the President of the Constitutional Court should have been informed by the member if there was any influence, as she has a legal obligation to do so.
According to him, the President of the Constitutional Court emphasized that under these conditions, she has addressed a letter to SPAK, asking it to notify her whether any of its members are being wiretapped or not.
" Before a member of the Constitutional Court files a report with SPAK, he should inform the President of the Constitutional Court and inform him of all the concerns he has about all the interventions. The fact that the President of the Constitutional Court said that she is not aware of such an issue whether it has happened or not, is why I have requested verifications at SPAK, which means that she is not aware of what happened to the members within them. She has acted as the defendant, so I do not know anything about what happened and I have sent a letter to SPAK, I want an answer and that's it ," he emphasized.
