Lawyer Spartak Ngjela, commenting on SPAK's movements and the arrest of Erion Veliaj, said that we still do not have an indictment against the Mayor of Tirana.
"But he says they didn't charge me, why is he being charged? Why does this court not understand what he said? We don't know if the court ordered his arrest. But the court arrested him, not the prosecutor," he says.
Regarding Veliaj's claim that prosecutor Ols Dado called him 'filth' in the courtroom, Ngjela says that if something like that is true, Dado can no longer be a prosecutor.
"Is there evidence that it happened? Every defendant has the right to speak? But we need to see if it's true? If it's true, he can no longer be a prosecutor. If it happened that he said that, he can no longer be a prosecutor in a democratic country," he said.
As for the claims about SPAK's methods as those of state security, Ngjela emphasizes that there can be no parallelism here.
"The security methods, they didn't need protection. They don't come close to them. You didn't even have the right to a lawyer. There's no parallel. Whatever the violation of the law, that legal situation, I can't imagine it happening in another country in Europe," the lawyer says.
So far, according to Ngjela, only Ols Dado has been involved in the investigation and not Altin Dumani.
"According to the law, Dumani has nothing to do with the accusation. He heads the prosecution, but the investigation is led by the direct investigator. I have not seen him being directly investigated. If they are both, the problem changes. So far, we have only seen Ols Dadon," he said.
The lawyer speaks out about the need for a strong judicial system in the fight against corruption and crime.
"SPAK has competence against corruption and organized crime. All bourgeois states have perfected the judicial power. We did not have judicial power. Capital wants money. If it were not for capital's desire for money, Marxism would not have emerged. It is not corrected with dictatorship but with judicial power. We still do not have a capable judicial power. But as far as I understand, there are American experts in SPAK. They are not experts who give orders, but analyze crime. Crime is a psychic system. Crime is a psychic system, the psychic desire of the person to commit a crime. This is called intent. This is the will in crime. But there is also crime in the norm, tax evasion is created. There is no commercial capital with tax evasion if we had a solid judicial power," he says.
According to Ngjela, the Americans did not flee from SPAK, as other experts arrived.
"Just as there are flaws, there is also a lack of professionalism. But in SPAK, 8 experts have left and 8 others have come. The issue of proof is not that easy. It is professionalism. I know what proof means, your relationship with the truth," he adds.
Regarding Berisha's statements that he will dissolve SPAK if he comes to power, Ngjela says that something like that will not happen because Berisha cannot come to power.
"He himself said, if I come to power, that is, if. If Saliu comes to formulate, no. It's the polls. The polls show him very low compared to the socialists. We'll see in the last month if his shares increase. But we know that his shares have decreased due to non grata. He is fighting to remove the non grata women," says Ngjela.
He then added that Chris LaCivita didn't take responsibility for anything regarding non-women, which means it's a serious problem.
"I didn't take on the problem of non-women. It's very serious. When you find an American personality who is going to be removed, then something has played out," he said.
