SPAK submits claim for 'Sterilization' case and requests prison sentence for 8 defendants
The Special Prosecution Office against Corruption and Organized Crime has read the claim in the "Sterilization" file, requesting prison sentences for 3 defendants.
SPAK is requesting 10 years in prison for former Deputy Minister Klodian Rjepaj , while the summary trial reduces the sentence to 6.8 years in prison.
SPAK is also seeking 10 years in prison for businessman Ilir Rrapaj , who, if convicted, will benefit from a shortened trial and will serve a shortened sentence of 6 years and 8 months.
For Marsela Serjani, SPAK requests 3 years and 7 months in prison, with a shortened sentence of 2 years and 4 months.
For Arben Gjata, SPAK is requesting 2 years in prison, which with a summary trial is reduced to 1 year and 4 months in prison and suspended to 3 years of probation.
SPAK is requesting 2 years in prison for Genc Burazeri , with the verdict being reduced to 1 year and 4 months and suspended for 2 years of probation. It is also requesting the same sentence for Naile Ajazi .

Genc Byrazer and Naile Ajazi were also converted to 2 years of probation.
Former Minister of Health Ilir Beqaj is also involved in this case. On May 28, the Court Against Corruption and Organized Crime decided that he should be tried separately under ordinary procedure.
Former Minister Beqaj, as well as the other defendants, are accused of several criminal offenses, such as corruption, violation of equality in tenders, fraud, failure to declare and conceal assets.
The Special Prosecution Office completed the investigations into the Sterilization concession on March 30, 2024 and sent the file for the former Minister of Health, Ilir Beqaj, his former deputy Klodian Rjepaj, the businessman who won the tender, Ilir Rrapaj, as well as 6 other unnamed individuals to the Special Court.
According to SPAK's investigations, former Deputy Minister of Health, Klodian Rjepaj, in his capacity as Chairman of the Concession Award Commission, carried out all financial calculation actions and changed them several times in order to achieve the financial indicators IRR and NPV at levels accepted by the Ministry of Finance.
Investigations have revealed that the number of surgical interventions was falsely reported in documents submitted to the Ministry of Finance, the Special Prosecution Office announced.
Also in these financial indicators, Klodian Rjepaj, in order to reduce the IRR and NPV rate, has added as service cost items during the duration of the concession, maintenance of instruments, systems and the sterilization plant, at values several times higher than the value of their new purchase.
Also, in the Public Sector Comparator, as the main indicator for awarding this project with Concession/Public Private Partnership, false costs of this service in the QSUT for 2013 were used, setting the values of medicines and medical drugs, which are not part of this service. This cost has been falsely increased and overestimated by 56.4%.
According to SPAK, throughout the entire preparatory period of the project, the tendering procedure and the granting of the concession until the signing of the concession contract, Klodian Rjepaj has closely collaborated with Ilir Rrapaj, with the aim of announcing the winner of the economic operators, where the participant is the commercial entity "Investital Llc" with a 40% stake, represented by the businessman.
Rjepaj, in his capacity as Chairman of the Concession Awarding Commission, as the person who prepared the financial statements and the feasibility study, in collaboration with other members of the commission, Marsela Serjani, Petro Mersini, Arben Gjata, Saimir Kadiu, Genc Burazeri and Naile Ajazi, is accused of having legalized these documents with false data.
While former Minister Ilir Beqaj is accused of actions or omissions related to the approval and signing of this concession contract, by approving them in violation of the rules and legal and sub-legal acts applicable to concessions, it is fully proven that he has consumed the elements of the criminal offense of "Abuse of office", committed in collaboration with Klodjan Rjepaj.
