The court of Vlora has sentenced to 4 years imprisonment, the businessman of the "Ambel Beach" complex Helidon Gjikoka, who is accused of "Forgery of stamps and forms" and "Forgery of documents".
The decision was made yesterday by Artan Çiraga, who read the final decision about the criminal case that had as its object the alienation of 1430 square meters of land.
During the presentation of the claim, the prosecutor, Edmond Vorfi, had requested the punishment of Gjikoka with 6 years and 4 months of imprisonment.
The reduction of the sentence imposed by the court in this case occurred due to the shortened trial.
Meanwhile, the court of Vlora decided to declare guilty and sentenced to 1 year and 6 months in prison the two former officials of Hipoteka and ALUIZNI in Vlora, Andi Haxhiraj and Ermal Mahilaj, who were accused of "Forgery of documents".
Only Ariton Kasaj, a lawyer by profession, was acquitted, for whom the prosecution, during the reading of the claim, had requested a sentence of 2 years imprisonment for the charge of "Forgery of documents".
But the prosecutor of Vlora, Edmond Vorfi, warned that he would appeal this decision for innocence.
Also during the rendering of the decision, the judge of the case Artan Çiraga decided the destruction and unusability of about 20 forged documents, with which 1430 m2 of land was alienated in the area of Pelivolos in Dhërmi.
According to the investigation file, it is about a land area of 1430 m2, located on the front line of the "Jon" sea coast, which was obtained according to law 7501 by the citizen Arqile Koka.
Then the latter, in August 2007, donated it to the citizen, Ilir Koka, in his will.
The investigation has proven that on the property with no. 36/9 which is owned by Ilir Koka, the latter has built several holiday cabins and which were then rented by his cousin, Helidon Gjikoka, from the city of Vlora who has named the complex of 12 buildings with the name "Ambel Beach ".
The lease contract dated September 27, 2018, was apparently signed before the notary Saimira Hoxha, between Ilir Koka and Helidon Gjikoka.
But the prosecutor's office shows from the conducted investigation that another person, the lawyer Ariton Kasaj, signed on behalf of Ilir Koka in this case.
According to the prosecution, this contract expires on August 31, 2021 and Helidon Gjikoka must leave the facility.
But the investigation carried out by the prosecutor's office of Vlora, has revealed that Helidon Gjikoka submitted to "ALUIZNI" request no. 2286 in order to legalize in his name 12 buildings built on the surface of 1430 m2 of land.
The investigation has proven that since January 28, 2019, these assets are owned by Helidon Gjikoka, this is proven by the Mortgage certificate issued on the same date by Vlora Mortgage, which registered the property on behalf of Helidon Gjikoka.
