Tirana Mayor Erion Veliaj is seeking his freedom at the Constitutional Court. Veliaj has been in detention since February 2025, when he was arrested by order of SPAK, while the GJKKO upheld the request of the Special Prosecution.
With a request addressed to the Constitutional Court, after the latter previously overturned the decision to dismiss the Mayor, Veliaj is seeking the annulment of the decision that imposed the security measure "prison arrest" on him.
The 8-member panel of the Constitutional Court has reviewed the request made by Erjon Veliaj. Initially, the panel of 3 judges did not have a consensus on whether or not the Constitutional Court should review the matter, and the decision was left to the Assembly of Judges. By majority vote, this assembly today passed the matter to a plenary session. Veliaj filed an individual appeal to the Constitutional Court, after exhausting the Appeal of the Constitutional Court and the High Court.
In the request addressed to the Constitutional Court, Mayor Veliaj requests "the repeal as incompatible with the Constitution of the Republic of Albania of decisions no. 7, dated 09.02.2025 of the Special Court of First Instance for Corruption and Organized Crime, validated through decision no. 14, dated 12.02.2025, of the Special Court of First Instance for Corruption and Organized Crime; (ii) decision no. 13, dated 13.03.2025 of the Special Court of Appeal for Corruption and Organized Crime; (iii) decision no. 00-2025-1153 (176), dated 08.07.2025 of the Criminal Chamber of the Supreme Court".
The mayor of Tirana has been in custody since February of last year and is accused of a series of criminal offenses such as money laundering, failure to declare assets, passive corruption in 9 episodes, abuse of office, and bringing prohibited items into the cell.
His wife, Ajola Xoxa, is accused of failing to declare assets, concealing income, and money laundering. Also included in this file is former socialist MP Klotilda Bushka, who is accused of actions that hinder the discovery of the truth.
On November 3, the Constitutional Court ruled in favor of Erion Veliaj, keeping him in office as mayor of Tirana. The Constitutional Court overturned the government's decision to dismiss him and annulled President Bajram Begaj's decree calling early elections in Tirana.
