The trial against Fatmir Mediu has taken a different course. Although for several weeks everyone is waiting for the prosecutor's claim for the former Minister of Defense regarding the tragedy of Gërdec, even today such a thing did not happen.
The court postponed the session, accepting the families of the victims of the tragedy as parties to the process. Although the family members have been asking for this for 3 months, the court only now accepted this request, causing the process to change now. This is because the family members will be asked and their requests will be taken into account.
GJKKO took the decision to notify the 290 injured persons who will participate in the next session. This development has two sides. On the one hand through this movement maybe the trial will be delayed. But on the other hand, it is a victory for the family members, as their statements and attitudes will probably convince the court and the prosecutor's office that Fatmir Mediu will not be let alone.
The court passed the Mediu file for trial in April. There was a lot of delay before going to trial. But even after the trial began, there was no full hearing. The medium used many maneuvers to escape punishment. His lawyers asked for a summary judgment and the court granted it. After that, the prosecutor's claim was requested. But the claim is postponed for 3-4 sessions.
Meanwhile, today Mediu came out with a new request, not accepting summary judgment. If his request is accepted, the trial can go to normal steps and it means that we will have delays again. It also seems that justice is not so ready to give a one-time decision on this case.
Fatmir Mediu is accused by SPAK of abuse of office in two cases. Meanwhile, the families of the victims demand that he be punished for murder. It remains to be seen what course the trial will take.
Dorian Matlija, the lawyer of the Durda family, a family which lost its son in the tragedy of Gërdec in 2008, said that the family is now a party in the criminal case and will fight side by side to seek justice.
" The history of victim participation in criminal cases is a very long struggle. The victims are part of the process and are side by side to choose the case. It would make a public announcement. They have rights to write all kinds of things. It is a victory for the Durda family, as they have made efforts a long time ago. New evidence cannot be presented in a summary trial. In a regular trial anything can happen. I mean the interest of the family members is consistent. Only the truth sets people free," said Matlija.
Meanwhile, Zamira Durda said that this is a small victory for them. She said her son was killed on the orders of the minister.
" A small victory. Let's see how it will go. The evidence is public. The weapons arrived, the minister's order killed my son ," said Durda.
