Contradictory statements about his studies, parallel full-time employment, two unbelievable diplomas and direct links to the body that vetted him. The Mustafaj dossier raises serious suspicions of forgery, conflict of interest and favoritism, which require an urgent investigation by SPAK and the justice institutions.
The facts and indications that we have published regarding the tarnished image, questionable university education and favoritism in the vetting process of the Head of the Fier Prosecutor's Office, Elion Mustafaj, should be subject to verification and administrative investigation by superior institutions.
But they should also be investigated by SPAK, because the written facts in the self-declaration of prosecutor Elion Mustafaj and in the vetting decision create reasonable doubts that prevent his continuation in office and require facing justice, like some of his colleagues for the same facts.
4-year cycle and Master's degree, in parallel when his uncle was head of the Faculty of Law
SPAK should investigate the documents published by “Pamfleti”, which prove that the Head of the Fier Prosecutor’s Office, Elion Mustafaj, has contradictory statements about his education and employment.
On May 1, 2004, at the age of 24, he started working as a full-time chancellor at the Durrës Prosecutor’s Office; while in the same period he declares that in the years 2003–2007 he completed his full-time studies at the Faculty of Law of the University of Tirana.
For the same period, Elion Mustafaj declares that he also completed a “Master of Science” at this faculty, although in parallel he was a student in the first 4-year cycle for a lawyer.
Employment as Chancellor in the Durrës Prosecutor's Office, completion of studies and graduation as a Lawyer with the full 4-year cycle "with separation from work", as well as the Scientific Master, in the same time period 2003–2008, coincides with the years when his uncle, Prof. Dr. Skënder Kaçupi, was a professor, head of department, deputy dean and dean of the Faculty of Law.
SPAK should investigate the time discrepancy and the fact that a person employed full-time as Chancellor in the prosecutor's office cannot be a full-time student and at the same time have completed postgraduate "Master" studies in the same years as the first cycle.
The university studies file, the registration numbers and the two graduations of prosecutor Elion Elmas Mustafaj are in the secretariat of the Faculty of Law.
There it can be verified how and who accepted him as a full-time student when he worked full-time as a chancellor at the Durrës Prosecutor's Office; and who accepted him to study in the second cycle "Master", in parallel with his studies in the first 4-year cycle.
Uncle's connections helped him pass the vetting, although there are many "spots"
An investigation should also be conducted into the vetting file of the Chief Prosecutor of Fier, Elion Mustafaj, because the members of the re-evaluation body, Valbona Sanxhaktari, Olsi Komici and Firdes Shuli, who vetted prosecutor Elion Mustafaj, are former students of his uncle, Prof. Dr. Skënder Kaçupi, but also selected and certified by him in the Independent Qualification Commission.
Without his uncle's influence, prosecutor Mustafaj could not have passed the vetting, when there are many blemishes:
- His wife is employed by the company of a person convicted of robbery in England and has benefited financially from him.
- Has direct connections to businessmen, traffickers and lawyers involved in SPAK files.
- There is a discrepancy between assets and expenses compared to personal and family income.
- There are 7 criminal charges and 60 denunciations during the exercise of his duties as a Judicial Police officer and as a prosecutor in Vlora, Korça and Lushnja, for favoring subjects of corruption and crimes, by not prosecuting them, by removing evidence and by dismissing cases. / Pamphlet
