The legal battle for the Brand and Exclusivity of the energy drink "B52" in Albania has been won by the Albanian company "Arseni Sh.pk" against the Dutch company "BAVARIA NV", with Decision no. 7121, dated 24.06.2013 of the Tirana Court; Decision no. 1868, dated 06.05.2014 of the Court of Appeal and Decision no. 112, dated October 5, 2017 of the Supreme Court.
At all 3 levels of the judiciary, it was decided that the energy drink "8S2", a product of the Dutch company "BAVARIA NV", should not be imported, produced or packaged and marketed as a brand in the territory of Albania.
In the same way, any other energy drink is prohibited, which has color matching, imitation and manipulation of packaging in special elements, names, designs, symbols and logos, while the Directorate of Trademarks and Patents does not register it as a market product in the territory of Albania.
However, for 7 years, a "cub" named Ago Imer Gjolaj from Kopliku, filed for trafficking, money laundering and smuggling, has entered the Albanian market, not only with the fake drink "B52", also banned by the decision of the Supreme Court , but has also added 2 other types of energy drinks "8S2" and "S52", which are imitations and copies such as packaging and logo with the exclusive legal energy drink "B52" of the company "Arseni Sh.pk".
The government should deal with the scandal that the Brand-Patent Directorate under the Ministry of Finance-Economy has registered as "Brand" the 3 illegal and fake drinks "B52", "852" and "S52" of the trafficker Ago Gjolaj.
The Director of Trademarks and Patents, Rovena Beqiraj, former director of concessions and signatory of landfills, whose name is at the epicenter of the SPAK file, refused to deregister these fake drink brands banned by the decision of the Supreme Court. , as the boss who pressured subordinates to sign every letter that Klodian Zoto sent.
The others who do not follow the decision of the Supreme Court, to force the director Rovena Beqiraj, to de-register the illegal and fake drinks "B52", "852" and "S52" of the trafficker Ago Gjolaj, are 6 members of the Supervisory Council of Marka -Patents.

Banda e Marka-Patentave, ka ngritur formalisht edhe një Bord Apelimi me 5 anëtarë që mbahen sekret, bord që drejtohet nga ministresha Delina Ibrahimaj, të cilët trajtojnë ankesat për regjistrim- ç’regjistrimin e markave të prodhimit në treg, ku kompania “Arseni” përfaqësuese ligjore e ekskluzivitetit të pijes “B52” ka bërë mbi 50 kërkesa për ç’regjistrimin e pijeve false, ilegale e imitim ambalazhi “B52”, “852” e “S52” futur në treg nga Ago Gjolaj por nuk veprohet.
