SPAK passed it to the Prosecutor's Office of Tirana "For lack of competence", when SPAK has the competence to investigate, because the crime was committed in an organized group, in the state registers and a construction permit was obtained from the state, but also because of the fact that the forger Luan Bregasi is a Member of the Municipal Council of Tirana where he received the permit for the tower and Member of the Board of the State Investment Agency...
On August 1, 2023, the National Council of the Territory granted Luan Bregas a construction permit to the "Paris Municipality" for a 34-story tower called "New Paris", obtained on behalf of the "Sara-El" company, which is filed for money laundering by the anti-mafia agencies of Albania and the US-EU.
Letter of SPAK with No. K-386/7, dated July 4, 2023; Letter No. 3846-SH/1, dated July 19, 2023 of the Tirana Prosecutor's Office; Decision no. 1269, dated October 6, 2020 of the Court of First Instance of Tirana and Decision no. 79, dated February 15, 2023 of the Court of Appeal, prove that Luan Bregasi has falsified the property file of the land where he will build the 34-story tower.
Although the Mayor of Tirana, Erjon Veliaj, received these official documents from the investigative and decision-making institutions of justice, before giving the construction permit to the company "Sara-El Sh.pk" of Luan Bregasi, he permission was granted for the "New Paris" tower.
Even the National Council of the Territory, chaired by Edi Ramën, has approved the permission given by the municipality, although it had the documents proving that Luan Bregasi falsified the property cards, the map, the area and presented false documents of ownership of the land.
Luan Bregasi made this forgery with the Tirana Cadastre officials during the time of Artan Lame; with whose approval, the plots of land were moved from sections "C" and "D" to section "E" of the property card of the cadastral area, according to the falsified version presented by the company "Sara-El Sh.pk"; and on these stipulations, permission to build the tower was granted.
So, in the property card and on the map, sections "C" and "D" were deleted and moved to section "E", robbing the land of the legal owners, while on January 10 and April 12, 2023, certificates and cards were given falsified property, on account of the construction permit that Luan Bregasi requested and received.
SPAK found this property crime, but passed the file to the Prosecutor's Office of Tirana "for lack of competence"; when according to the Code of Criminal Procedure, SPAK has investigative competence.
Because the crime was committed in an organized group in the state registers, that through it a construction permit was obtained; but also for the fact that the forger Luan Bregasi is a Member of the Tirana Municipality Council where he received the tower permit and a Member of the Board of the State Investment Agency.
An indication for the SPAK should be the fact that in the tower construction permit file, Luan Bregasi has declared the investment of 38 million Euros outside the bank line, without declaring the source of the profit, insurance and their origin./ Pamphlet
