The successive decisions of the KLP on the appointment and reappointment of prosecutor Elion Mustafaj show an unclear scheme of his institutional turnover, which coincides with key periods when he was under suspicion of links to illegal financing, employment in the US at the firm of Dorian Puka, a person convicted of robbery and under investigation for drug trafficking and money laundering. Instead of investigating his activity during his one-year stay in the US, the KLP transferred Mustafaj to Lushnje, where within 16 months it appointed him eight times as a simple and leading prosecutor. The file sent by American agencies was ignored, while the prosecutor passed the vetting in Lushnje. On June 9, 2023, he was appointed head of the Fier Prosecution Office, with suspicions of lobbying from mafia circles. The Mustafaj case clearly exposes the KLP's roundaboutness, the lack of filtering of figures and the influence of criminal structures on key appointments in the system.

The KLP has set a record with the appointment of Mustafaj to Lushnja, just one year after he returned from the US where he stayed for "family reasons". Within 16 months, Mustafaj has been appointed eight times to the Lushnja Prosecution Office, as a simple or leading prosecutor, even making two appointment decisions on the same day: on September 16, 2021 and on September 16, 2022.

On May 1, 2020, when he was a prosecutor in Vlora, Mustafaj left for a year in the US. On his return in April 2021, he arrived with a black file compiled by American agencies. Instead of investigating that file, KLP on September 16, 2021 sent him to the Lushnja Prosecutor's Office, where he also underwent vetting.

After a 16-month period filled with successive appointments to the same prosecutor's office, on June 9, 2023, the KLP appointed Elion Mustafaj as head of the Fier Prosecution Office. According to information, this appointment was pushed forward by mafia circles seeking to keep a figure in the system that was beneficial to their interests.
