The Princes of Wales have come out in public at a particularly delicate time for the royal family, following the arrest and release of Andrew Mountbatten-Windsor. According to the Mirror, someone in the crowd at the Bafta Awards shouted to William and Kate: “Is the monarchy in danger?” That’s the question many are asking. The Epstein scandal could change the face of the British Crown forever with a potential shake-up of the line of succession.

Expulsion and abdication

At this moment, the future of the Crown is linked to two keywords that have been heard frequently lately: exclusion and abdication. The first refers to the possibility of removing the former Prince Andrew from the line of succession to the British throne. Elizabeth II's favorite son has been stripped of everything from titles to residences, but not the eighth place in the list of potential heirs to the United Kingdom. At least not yet. The British government will begin the procedures for the final removal of the former Duke's name.

 Prime Minister Starmer “is open to passing a law,” writes The Times, once the police investigations are complete. However, this may not be enough to calm the outraged citizens: corruption has reached the heart of the Crown and the British press is wondering whether the best solution to guarantee the future of the monarchy would not be the abdication of Charles III and the accession of William and Kate to the throne.

A complicated procedure

Andrew's exclusion from the line of succession is an increasingly concrete hypothesis. The problem is that it is not as simple as it may seem. As the Cbc explains, the decision to exclude the former Duke cannot be made by the King alone. The British Parliament and the governments of the 15 Commonwealth Realms (countries that recognize Charles III as Head of State) must act in unison. Specifically, the Act of Parliament must be approved by the House of Lords and the House of Commons and, ultimately, the assent of Her Majesty is required.

"A barrier"

The act of exclusion would be mandatory not only because of the seriousness of the allegations, but also because it would represent a clear stance from the royal family. Or rather, a necessary distancing from the former prince and his more than dubious connection with Epstein. “There is a strong desire, within the government and the Palace, to put a barrier between this crisis and the monarchy,” historian David Olusoga told BBC Newsnight.

Impossible, but not ruled out

It doesn't matter that Andrew Mountbatten-Windsor's accession to the throne is a highly unlikely event: "Andrew is low in the line of succession. There are others ahead of him who are younger and in good health. Let's be realistic: there is practically zero chance of him becoming King," Robert Finch, president of the Monarchist League of Canada, told the CBC. However, unlikely does not mean ruled out. Sir Ed Davey, leader of the Liberal Democrats, told the BBC that "it is a matter that Parliament will consider at the appropriate time ... the monarchy will want to make sure that Andrew never becomes King." After all, caution is never too much.

Law of 2013

From a technical point of view, the change in the order of succession is not unprecedented. This happened most recently in 2013, as the official website of the royal family and the BBC recall, when the Succession to the Crown Act amended the provisions of the Bill of Rights (1689) and the Act of Settlement (1701). The priority of male primogeniture was abolished and absolute primogeniture was established (so, today the gender of the heir is no longer discriminatory: Princess Charlotte can no longer be surpassed by her younger brother Louis in the line of succession). The rule that excluded heirs who married a Catholic from the line was also abolished. The new law applies to those born after October 28, 2011.

Two precedents

Turning then to history, we find two cases of exclusion from the dynastic line. The first is the Catholic king James II. During the Glorious Revolution (1688–1689), the sovereign fled to Paris. Parliament decided to entrust the throne to his daughter, Mary II Stuart, the wife of William of Orange (William III). Both were Protestants. Their reign marked the beginning of constitutional monarchy, where the role of the sovereign was regulated and limited by Parliament through the Bill of Rights and the Act of Settlement. The second case is Edward VIII, in 1936. After abdicating, the former king (and his potential successors) were excluded from the line of succession. However, as Robert Jobson points out for Hello, “no one has ever been forcibly excluded from the British inheritance”. Edward VIII “voluntarily” abdicated the throne to marry Wallis Simpson. In the case of James II, it was Parliament that declared the abdication, but the monarch never accepted it.

How will the order of inheritance change?

If the government approves the former Duke of York’s exclusion and the Royal Family “does not object,” as a source told Tatler, the order of succession could change. Of course, Prince William and his children will not be affected. The same goes for Prince Harry and his children Archie and Lilibet Diana, in fifth, sixth and seventh place respectively. The issue affects the heirs after Andrew: immediately after him are Princess Beatrice (ninth), her daughters Sienna and Athena Mapelli Mozzi (tenth and eleventh), Princess Eugenie (twelfth) and her children Jack and August (in thirteenth and fourteenth place). If the Parliament measure affects only Andrew, his daughters and grandchildren will move up one place. If all of his descendants are excluded, their place will be taken by the Duke of Edinburgh, Prince Edward (currently fifteenth), and his children, James Mountbatten-Windsor (sixteenth) and Lady Louise Mountbatten-Windsor (seventeenth).

Will Charles abdicate?

According to Tatler, it is unlikely that the King would want to exclude Beatrice and Eugenie from the line of succession. He is close to them and does not want them to pay for their parents' mistakes. However, it is not certain whether excluding the former Duke of York will be enough to save the monarchy, although according to a recent YouGov poll, 82% of Britons would support such a decision.

For days, the media has been wondering whether it would be more right for Charles to step down. According to sources close to the Palace, however, His Majesty has never considered this idea. He has waited a long time to realize his reign and will not allow Andrew to destroy what he has built. "The King will stay. Period," a source told journalist Rob Shuter.

"This is Andrew's crisis, not the Crown's. Charles has already severed the connection. That chapter is closed."
