The International Criminal Court has ruled against Israel and Hamas.
Chief Prosecutor Karim Khan filed a request before Pre-Trial Chamber I to issue arrest warrants against Tel Aviv Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, as well as three leaders of the Palestinian terrorist organization, Yahya Sinwar, Mohammed Deif and Ismail Hanyieh. for alleged war crimes and crimes against humanity in the Palestinian territories and the Jewish state. Prosecutor Khan also added that “the effects of using starvation as a method of warfare, along with other attacks and collective punishments against the civilian population of Gaza are acute, visible and widely known. They include malnutrition, dehydration, deep suffering and a growing number of deaths among the Palestinian population. The mandate addressed to the three Hamas leaders, however, speaks of "extermination, murder, hostage-taking, rape and sexual violence during detention."
The reaction of the Israeli political world was very harsh. "The State of Israel has launched the most just war, after the massacre of its citizens by a terrorist organization. The State of Israel fights in the most moral way in history, respecting international law and has a strong and independent judicial system," said Minister Benny Gantz. "To put the leaders of a country that went into battle to protect its citizens on the same page as bloodthirsty terrorists is moral blindness and a violation of its duty and ability to protect its citizens," he said. The leader of Tel Aviv also emphasized that accepting the post of chief prosecutor would be "a historical crime that will not disappear." A senior Israeli source told Ynet newspaper that he considered the prosecutor's decision "hypocritical and internationally embarrassing" and that the decision left Jewish officials "shocked".
For their part, Benjamin Netanyahu and Yoav Gallant can benefit both from the fact that Israel has not signed the Statute and from the "shield" of the United States, a key nation that does not recognize the authority of the Hague court and that can apply pressure to the Court not to continue the procedure. Already in early May, when Chief Prosecutor Karim Khan announced that his team was investigating alleged war crimes committed in Gaza, Washington had made it known that it was "not in favor" of issuing arrest warrants targeting Jewish leadership. . The situation, therefore, may evolve in a similar way to what happened with the arrest warrant against Vladimir Putin, whose main objective was to make the Russian president an international "pariah".
Meanwhile, American President Joe Biden also spoke, calling the request of the chief prosecutor of the International Criminal Court "outrageous" for an arrest warrant against Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant. "The ICC prosecutors' request for arrest warrants for Israeli leaders is scandalous. And let me be clear: whatever this prosecutor might mean, there is no equivalence – none – between Israel and Hamas. We will always stand with Israel against threats to its security," Biden said.
His senior aide, Secretary of State Antony Blinken, criticized the move, raising questions about the court's jurisdiction and its process for making the request. He added that this could jeopardize negotiations to reach a hostage deal and a ceasefire. Blinken said Israel was prepared to cooperate with the court and that the prosecutor was scheduled to visit Israel as early as next week, but instead went on cable television to announce the charges.
