The Court of Justice of the European Union has ruled in favor of Italian judges on the Italy-Albania protocol, but only for a maximum of 10 months, until the new European regulation that will change everything comes into force.

Palazzo Chigi's concern is understandable, underlining that "in identifying the so-called safe countries, the decision of the national judge, also based on private sources, prevails over the results of the complex investigations carried out by the relevant ministries and evaluated by the sovereign Parliament".

This is an interpretation that, according to Palazzo Chigi, "should worry everyone, including the political forces that are now rejoicing over the decision, because it further reduces the already limited limits of the autonomy of governments and parliaments in the regulatory and administrative management of the migration phenomenon".

Matteo Salvini also took a rather harsh stance, calling the decision "scandalous" because it "limits the ability to control borders, fight human traffickers, limit landings and eliminates its national regulations. Another demonstration of a Europe that doesn't work."

This, the League leader added, "concerns me, not as prime minister, but as an Italian citizen. Because if someone in Europe limits my ability to protect and control the borders, it's a big problem."

If any magistrate wants to get involved in politics, the deputy prime minister added, "let them run for office. Let them stop being magistrates, both in Europe and in Italy, because Italians want more security, more tranquility, more peace."

This decision, Salvini concluded, "is a serious precedent not only for Italy, but for all of Europe. It is another demonstration that these European institutions, as they are, are a disaster."

For Sara Kelany, a Fratelli d'Italia MP and head of the party's Immigration Department, "this is an anti-democratic absurdity that risks blocking the repatriation system throughout the European Union."

"The left, which, as is its tradition, celebrates the triumph of bureaucracy over politics and mentions the alleged failure of the Italy-Albania agreement, forgets that this is fully in line with new EU legislation, which, as the Court itself recalls in its ruling, will enter into force no later than June 2026 and expressly provides for the power to designate safe places with territorial exceptions and by category of person," she says.
