Justice vs. Executive : Is no one above the law? The recent debate over amendments to the Criminal Procedure Code, which aim to strip SPAK and the Special Court of the right to suspend ministers or heads of constitutional institutions, directly touches the core of democracy: Equality before the Law.
When we talk about "Checks and Balances", we do not mean that the powers are untouchable "islands", but that they check each other to prevent authoritarianism.
Why is suspension restriction dangerous?
If a minister under investigation for corruption cannot be suspended by the court, a constitutional inequality is created:
* Damage to evidence : A senior official has control over the seals, archives, and subordinates (witnesses).
Staying in office gives him the opportunity to destroy evidence of the crime.
* Pressure on justice : A minister "with de facto immunity" uses the power of the state to protect himself, turning the criminal process into an unequal battle.
World Experiences: When Justice "Touched" the Executive
History shows us that democracies are strengthened when justice does not stop at the minister's office:
* Italy (Mani Pulite) : In the 90s, prosecutors like Antonio Di Pietro dismantled the corrupt system of "Tangentopoli".
The debate was the same: Is justice interfering with politics?
The result? Immunities were removed and the law became equal for all, saving the state from decay.
* Brazil (Lava Jato) : Judges ordered measures against high-ranking figures, including former President Lula. Although fiercely debated, this process showed that no position is a "shield" from accountability.
* France & Israel : In France, ministers like Christine Lagarde have faced special courts without blocking the process, while in Israel, the Netanyahu case has shown that a defendant's continued tenure produces endless constitutional crises.
Conclusion: The Thin Line of Democracy
If legal changes create "castes" that the court cannot touch, we no longer have a separation of powers, but a disconnection of accountability.
The judge does not politically "fire" a minister; he simply guarantees that the investigation is not manipulated.
If this right is taken away from justice, then "Equality Before the Law" remains just a beautiful line on paper, but dead in practice.
