Why didn't Berisha, Rama, Meta vote for a Criminal Amnesty, to forgive themselves and their past deeds?

The dragging of the former prime minister Meta has opened a big debate in Albania. 4 prime ministers have been criminally prosecuted in these 30 years: Fatos Nano, Vilson Ahmeti, Sali Berisha and Ilir Meta.

This fact is enough to understand that the dragging was not well received even by Edi Rama, who may be investigated for the same criminal offenses in the future.

But did Meta, Berisha, Rama have the legal space not to have allowed this day to come?

Yes Yes, they had 100% legal means to prevent this day from coming. The Constitution provides in Articles 81 and 83 the right of the Assembly to vote on Criminal Amnesty. During these 34 years Berisha, Meta, Rama, Basha have approved several Criminal Amnesty by law.

In some Criminal Amnesty, thousands of people who have committed more serious crimes than corruption or abuse of office have been forgiven.

In some amnesties, people have been forgiven for life crimes, injuries, drug trafficking, theft, threats, fraud, etc.

Could Meta, Berisha, Rama include criminal offenses in these amnesties by law:

- Passive corruption

- Abuse of duty

- Concealment of wealth

- Cleaning "money" products

- Do not declare assets

The answer is: Yes, they could have voted and today they would not have been arrested because the law does not investigate amnestied criminal offenses.

They have not had any constitutional obstacle that if in 2013, 2017, 2020 or 2024 they had amnestied these criminal offenses, no one who had committed before the moment when the law was voted would not be subject to investigation and trial as the prosecution would be forced to dismiss the cases criminal because they would be amnesty offenses and the law has a retroactive effect.

Some of you will ask: Why didn't they vote for it?

In 2016, of the 4 political leaders, one of the diplomatic missionaries in charge of justice reform made you the last offer:

Vote for a Criminal Amnesty where you forgive each other for what you have done in the past on the condition that you stay out of politics.

The diplomat who made the offer to you was a friend of Albania and he argued the proposal with the need that Albania would benefit more from pardoning 4 government officials who held 4 million Albanians hostage.

He reasoned that if they do not forgive today, they will hold Albania hostage for 10 or 20 years until justice punishes them and removes them. I didn't understand it then, nor did I believe it.

After 10 years, it is worth asking: Was it worth it for them to have left and for Albania to be freed 10 years ago, or 10 years that we were dragged and lost from our lives?

The fact that they rejected Criminal Amnesty and did not vote to pardon each other is an indication that they never thought this day would come. The day came, but today they regret not being amnestied with some laws they voted for. Now it is too late for them and for the people who were dragged along for decades. No one can get back the lost years, not even the videos of arrests or seizures...
