Even in the case of "Beqaj" and in the case of the directors of the municipality, the courts have suggested tougher measures and attitudes than the prosecution itself requested. The "Salianji" case is also another case.
Undoubtedly, the unequal treatment of suspected offenders is an issue that deserves strong debate and criticism.
The truth is that our courts, especially the appellate courts, have several times taken aggravating decisions in relation to the courts of first instance and even harsher than the positions of the prosecution.
It is not in the nature of the impartial court and on the parties to suggest or decide on harsher measures than the parties in the trial require. The court was invented for justice, proportionality, equality and not for guillotine.
Our courts have done this several times. Even in the case of "Beqaj" and in the case of the directors of the municipality, the courts have suggested tougher measures and attitudes than the prosecution itself requested. The "Salianji" case is also another case.
Under these conditions, the decision of the Supreme Court to limit this extreme role of the courts, in the case of the directors of the municipality, is to be welcomed.
Personally, I do not have any respect for the role of the Supreme Court, due to the also extreme decisions it has taken in other cases, such as the Port of Limion, Metamorfoza, the Berisha case, the Beleri case, or the scandalous position of allowing seizure against third parties in thank you etc. But the idea of limiting judicial extremism is to be welcomed.
You go to court for the right, the balanced, the proportional, not for the extreme.
The appeal was invented for the pimp, not the state. The latter formally has the right of appeal, but the court exists to limit extremism, not to deepen it.
In this sense, the destruction of the decision that requires tougher attitudes than the prosecution itself suggests, for the directors of the Municipality of Tirana, deserves respect.
Let them be the directors of the municipality, and then what?!
Everyone has the right to defend themselves, no matter how big the crowd is.
"The directors are getting out of prison", is the news of the day.
But how do we do it? Do you rot in prison for the rest of your life?!
How logical is this?!
When you enter prison, you will also get out of it, people!
You have to seek justice more from the one you don't like, so that the justice you seek for yourself has meaning.
This is the essence of being fair.
