
The Prosecutor's Office of Lezha, together with the General Prosecutor's Office and the Ministry of Justice, have made a last attempt to be successful in extraditing from England Edmond Haxhi, together with the other four Britons, suspected of being involved in the murder of Ardian Nikulaj.
The letter of guarantee sent to the London court bears the signature of the head of the Lezhë prosecution, Erion Shehaj, specifying the type of charge that will be brought against Edmond Haxhina.
According to this prosecution, he is suspected of having the role of organizer in the murder, as he is accused of being involved in the purchase of the motorcycle used in the murder by Ruben Saraiva on April 19, 2023.
"Regarding the guarantee point 4 with which a guarantee is requested for Mr. Edmond Haxhia that he will not be accused of the criminal offense prescribed by Article 78/A, the prosecutors of the case state that in order to carry out the extradition process and present the case before the British Court in accordance with the British legislation, we give a guarantee/consent, that if his extradition is decided, the charge that will be formulated or raised against him will be different from "revenge murder".
In the criminal code it is sanctioned that "intentional murder for blood feud is punishable by imprisonment of not less than thirty years or life imprisonment". The chief prosecutor of Lezha gives another guarantee to the extradition court in London.
"If he is prosecuted, the charge will be for a different criminal offense and which, according to Albanian legislation, allows him to be released on bail."
The letter of guarantee also explains the scenario if the court will not agree with the referral of the case by the prosecutor's office to the charge not "murder for blood feud".
The Prosecutor's Office of Lezha guarantees the appeal in all instances of appeal.
This letter of guarantee answers the concern of Edmond Haxhi's lawyers, that if he is extradited, he will be sentenced to life imprisonment without the right to parole, and this contradicts the British extradition act.
This concern was the strongest card blocking the extradition of Edmond Haxhi supported by legal expertise, given as evidence in the extradition court in London, by the former judge of Albania in Strasbourg, Ledi Bianku.
This development with the sending of this letter of guarantee increases the probability that the decision of the London court on July 30 will be in favor of the request of the Albanian state requesting the extradition of Edmond Haxhi, Thomas Mithan, Steven Hunt, Harry Simpson and Harriet Bridgeman./TCH
