The court of Saranda sentenced the 68-year-old businessman Pando Papuçi to 2 years in prison, accused of "illegal construction", while he confiscated and transferred to the state the 7-story building at the entrance of Saranda.
In an official press statement, the Court of Saranda states that Papuçi was prosecuted within the framework of criminal proceedings no. 774 of 2021 together with three other persons accused of "abuse of duty". The file in charge of Papuchiu was separated from the other three and was tried separately with a shortened trial, while the case for the others, former officials, is still ongoing.
At the end of the Trial, Prosecutor Silvana Belishta asked for Papucci's guilty plea and his sentence of 5 years in prison for "illegal construction", but in the application of the shortened trial, the reduction of 1/3 of the sentence and his suspension by sentencing him with trial service. In addition, Belishta has also requested the removal of the preventive seizure against the 7-story building and the continuation of administrative procedures, as well as the punishment of the company "2P-SJ" with the "termination of the legal entity".
But judge Edona Vajushi has decided otherwise, who sentenced Papuçiu to 3 years in prison and in the application of the shortened trial to 2 years in prison. The sentence, according to the decision, must be carried out in a regular security prison. Vajushi decided the confiscation and transfer to the state of the 7-story building and the punishment of the company "2P-SJ" with the "termination of the legal entity".
The decision of the Court of Appeal is now awaited in order for the decision to take final form both for Papuchiu and for the building and the construction company.
Pando Papuçi was wanted since February 21, 2022 as part of the "Silence" operation for the criminal offense of "illegal construction", related to a 7-story building at the entrance to the city of Saranda, but he surrendered on February 9, 2024 and then the Court left it in the measure "obligation to appear".
The 7-story building has been embroiled in a long court battle dating back to 2006. Construction has since begun, but the building has not yet been completed. The Administrative Court of Gjirokastra decided on September 24, 2020 to postpone the deadline for the construction permit, which was originally granted on February 14, 2006. The court's decision does not specify for which construction company the construction permit is postponed. According to the prosecution, it should have been implied that the permit was postponed for the firm "Savrikal", which had received the permit in 2006, while the object was already being built by Pando Papuçi with his firm "2P-SJ".
The latter, together with the late Vangjel Nika, were the owners of the land where the facility is being built, contracting the relevant firm 18 years ago, which, for various reasons, stopped the works. For this reason, in August 2020, Papuçi creates a company himself and, after the Court decides to postpone the deadline for the construction permit, he starts work on the building in his property. Precisely for this reason, the prosecution accused the officials of the Municipality of why they did not interpret the court's decision, saying simply that "the object should be built by the construction company contracted in 2006 and not by the owner of the land, who had contracted this company". The prosecution claims that the decision should have been well interpreted by the IMT officials, but in point 5 of the court's decision, the heir of the late owner, Vangjel Nika, specifically his daughter, LK, is mentioned. In its decision, the court in point 5 has decided that "the developer LK, represented by proxy by Pando Papuçi, is obliged to notify the Municipality of Saranda in advance about the start of the works". In the decision of the Administrative Court, it is not specified for whom the construction permit was postponed, for the company or for the land owners. In the investigation file, it is stated that the inspectors of the Municipality have carried out checks in the said object, where on 20.10.2021 they signed a protocol of ascertainment in the object that is being built by the entity "2P-SJ shpk", for technical reasons of safety at the construction site. In fact, on 22.10.2021, with decision no. 15, the chief inspector of IVMT Saranda Municipality, imposes a fine on the subject "2P-SJ shpk", in the amount of 200,000 ALL and on 23.10.2021, with decision no. 10, the chief inspector of IVMT Sarandë Municipality decides to suspend the works of the entity "2P-SJ shpk", with a 60-day deadline.
