The Supreme Court upheld the decision to convict two police officers who were present during the arrest of Ilir Xhakjas, who shot dead the head of Shijak's police station, Adem Tahiraj.
In the decision made available to you by Top Channel, the criminal panel says that the two officers F.H and K.SH abused their duty and did not perform any action at the time the police chief was killed by not reacting to neutralize the event and the perpetrator, allowing that he then left the scene.

The panel has concluded that the court of first instance has found the defendants K. Sh and F. H guilty of the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code. Specifically, the court of first instance reasoned that the defendants are special subjects, who exercise a public function, since at the time of committing the criminal offense for which they are accused, they were on duty as police officers and they committed the criminal offense precisely because they had these qualities that stemmed from their duties. Regarding the objective side of this crime figure, the court of first instance reasoned that both defendants committed this criminal offense by inaction (i.e. by passive attitude), contrary to the regular fulfillment of the duty and in violation of the functional law for the state police.
This is because although they had the obligation to act and take concrete measures and there was a real opportunity to act (as persons with special skills to act in these types of pre-criminal situations) they did not act and as a consequence of this inaction Ilir Xhakja has committed the extremely serious criminal offense at the expense of the life of the Head of the Police Station. According to the court's assessment, the consequence that the law requires has been proven, namely the serious violation of public order and security, citizens' trust in the state, since the subject of the crime in this case was precisely an employee of the state police, who since taking over the duty, has accepted all the factual circumstances in which he may find himself during its exercise, assuming the obligation to apply the law of each case in order to protect the life of every citizen in the first place' is stated in the decision, which is added that the decision of the appeal is annulled and the one of the first instance that found the two police officers guilty is upheld
How the chief commissioner was killed
On September 13, 2012, by order of the Chief of the Police Station, the police forces of the Shijak Police Station were ordered to carry out patrols in the town of Shijak and its surroundings, up to Lapidari in Katundin e Ri. Initially, three police vehicles and five police officers were used in the operation, under the direction of the Chief of the Police Station. The vehicles had all the inscriptions and signs of the police visibly marked, as can be seen from the photo boards at the scene. The purpose of the patrol was to verify the documentation and title of ownership of vehicles with foreign license plates, without license plates and with dark windows that were circulating in the area.
In the file it is mentioned that "In the Chevrolet type vehicle with license plate "Police 2085" the Chief of the Police Station Shijak and the police officer F. H were patrolling, while the general police patrol consisting of the police officers H. SH and K. Sh were patrolling with the Chevrolet type vehicle, with the license plate "Police 2084", and the police officers V. XH and A. T were patrolling with an off-road type vehicle, also with inscriptions and all the distinguishing marks of the police. The vehicles moved in a single school, one after the other.
Initially, according to the plan of measures, the road towards the village of Katund i Ri was patrolled. On the road, near the school of Sukthi, the Chief of the Police Station ordered the return of the off-road type vehicle together with two police officers, to provide the necessary assistance after the notification of a fire, as it results from the statements of the persons who had know about the circumstances of the event.
From Lapidari to Katundin e Ri, the patrol has returned to the road to Shijak with one less vehicle in its composition. After some routine checks in the parking lot of the Complex "V. ", a vehicle without license plates was ordered to be escorted. Policeman H. SH was assigned to escort him to the police station. From this moment, the patrol continued with two vehicles under the direction of the Chief of the Police Station, accompanied only by officer K. G. and police officer F. H.
Following the patrol, another VW Golf type vehicle without license plates, belonging to the citizen Seid Gashi, was accompanied. From this moment, the vehicles on patrol line up as follows: The convoy was led by the vehicle with license plate "Police 2085", driven by the police officer F. H, where the Chief of the Police Station was in the first seat. Behind him came the VW Golf type vehicle, in the cabin of which were S. J. . g (father and son), while behind him came the vehicle with license plate "Police 2084" driven by officer K. Sh. .

Teksa automjeti Opel sapo kishte përfunduar, apo ishte duke përfunduar manovrën, në vendngjarje është afruar një automjet Mercedes, tip Regina 320, i pajisur vetëm me një targë të huaj në pjesën e pasme, i cili ka ndaluar përbri automjeteve të policisë. Prej tij ka zbritur një person, i identifikuar më pas si shtetasi Ilir Xhakja, person me precedentë të shumtë kriminalë. Ky person menjëherë është drejtuar tek automjeti tip Opel, ka hapur derën e pasagjerit dhe ka nxjerrë përjashta me dhunë punonjësin e policisë F. H. , duke iu drejtuar me fjalët: “Ç’punë ke ti me nipin tim?” (provohet se shtetasi Ledion Krasni është nipi i Ilir Xhakjes). Punonjësi i policisë F. H është prezantuar dhe personi që ka sulmuar, në një moment i ka ndërprerë veprimet ndaj tij. Në këtë konflikt është përfshirë dhe Shefi i Komisariatit, i cili në ushtrim të detyrës, e ka pyetur personin kush ishte dhe çfarë kërkonte. Sipas dëshmisë së punonjësit të policisë F. H , Ilir Xhakja ka reaguar në mënyrë të dhunshme, duke u shprehur “Unë jam ai që të q… motrën” dhe ka nxjerrë pistoletën nga brezi. Në këtë moment, Shefi i Komisariatit ka bërë mbrapa, duke i bërë thirrje shtetasit Ilir Xhakja që të mos afrohej, kurse punonjësi i policisë F. H ka ndërhyrë, duke i dalë para autorit dhe duke bërtitur disa herë me zë të lartë: “Është Shefi i Komisariatit…!” Autori, duke shtyrë me trup punonjësin e policisë F.
