Accusations against Berisha, Gazment Bardhi: SPAK violated the Constitution, the
Gazment Bardhi

The restriction of the freedom of movement of Mr. Sali Berisha, without the authorization of the Assembly, is a serious constitutional violation that raises strong questions about the reasons for SPAK's haste.

The Parliamentary Group of the Democratic Party has unconditionally supported the Justice Reform and the work of SPAK from the beginning. Albanians are witnesses of our efforts and battle to ensure an independent, impartial justice system that is not captured by the government. This is due to the fact that not just justice, but justice unaffected by inappropriate politics and influences, is a fundamental condition for a real fight against corruption and the culture of impunity.

Personally, I unreservedly support everyone's equality before the law. In a democratic country there should be zero immunity for parliamentarians. However, the Constitution of Albania, in the case of elected officials, has provided some additional guarantees, which must be ensured without any exception. When a security measure that limits freedom in any form must be assigned to a member of parliament, the prosecutor is obliged to request authorization from the Assembly.

Yesterday I became familiar with the decision of the Special Court against Corruption and Organized Crime that simultaneously assigns two security measures to Mr. Sali Berisha. Both security measures limit his freedom of movement. The restriction of the freedom of movement of Mr. Sali Berisha, without the authorization of the Assembly, is a serious constitutional violation that raises strong questions about the reasons for SPAK's haste.

Parliamentary immunity is primarily a guarantee for opposition MPs, even though the current opposition does not seek or expect protection, immunity or preferential treatment from the judiciary. However, for justice to be considered independent, to be treated and respected as independent, it must perform acts with the force of the law, based on evidence and with transparency, unaffected by the government and respecting the regular legal process.

I would personally vote in favor of any request from the justice bodies that would come to the Assembly, as a sign of my belief that no one should stand above the law or enjoy a special status in relation to each of our voters. This is also a difference from the Parliamentary Group of the SP, which in the past, when political interest wanted it, prevented the Prosecutor's Office from acting. However, if SPAK's violation and haste to not comply with the mandatory procedure required by the Constitution in this case was intended to create a false perception of shifting the opposition's battle from a battle against Edi Rama's regime, to a "battle ” in fairness, I want to ensure that this scenario will fail!

We opposition MPs do not have a battle with justice.

Even when we do not agree with its acts or decisions, we do not have a battle with justice.

Even when we see how the head of the incinerators, Edi Rama, who has approved 17 VKM within a day to favor the incinerator mafia, continues to walk free from his supervilla in Surrel to the Prime Minister, we do not have a battle with justice. On the contrary, we have encouraged and supported him to do his duty.

Even when we see how the head of the incinerators, Edi Rama, who has changed the concession law three times at the proposal of Klodian Zota to favor the incinerator mafia, continues to travel every day by charter as the leader of a rich country, we have no battle with justice. On the contrary, we have encouraged and supported him to do his duty.

Even when we see that the heads of sterilization, Edi Rama and Ilir Beqaj, instead of being in prison are in a room with the French President signing agreements on behalf of the Albanian state, we do not have a battle with justice. On the contrary, we have encouraged and supported him to do his duty.

Even when we see how a special law favors a businessman personally selected by Edi Rama to benefit about 800 thousand m2 of public property in the Port of Durrës and there is no action by justice, we do not have a battle with justice. On the contrary, we have encouraged and supported him to do his duty.

Even when we see how he approves the law on strategic investments to favor his friend Artan Gaci and the husband of his minister, and even has the courage to not implement a decision of the Constitutional Court regarding the mandate of deputy Xhacka, we do not have a battle with justice . On the contrary, we have encouraged and supported him to do his duty.

Even when we see how Olsi Rama, the head of Xibraka's laboratory, is not in prison, but his immunity as the brother of the Prime Minister serves as the only motive to promote the prosecutor of the case as the Prosecutor General of the Republic, we do not have a battle with justice. On the contrary, we have encouraged and supported him to do his duty.

Even when we see how Arben Ahmetaj is knowingly allowed to escape from Albania just a few hours before the request comes to the Parliament, we do not have a battle with justice. On the contrary, we have encouraged and supported him to do his duty.

Even when we see how the accomplice of the corrupt McGonigal gives us anti-corruption lectures, after favoring a Russian company in the oil field concession on behalf of his friend, we do not have a battle with justice. On the contrary, we have encouraged and supported him to do his duty.

Our only battle is with Edi Rama. Our only battle is for a better Albania, with a government at the service of the citizens and a non-corrupt government. The battle of every oppositionist is with Edi Rama's regime, his misgovernance, the corruption of his government, from which Albanian citizens suffer every day.

And in this direction, while we encourage justice to act strongly for the interest of the country and the public, and not for the interests of the politics of the day, I want to assure the citizens that the battle of the opposition united with the misgovernment of Edi Rama has been and will be uncompromising life, at any cost, with any democratic means, until Albania returns to normality and deserves the status of a NATO member country and a candidate country for the European Union.
