Americans: SPAK, political investigation against Arben Ahmetaj

The SPAK report reflects a politically motivated persecution of a high profile individual whose only mistake was clashing with the ruling elite.

The former American Prosecutors have made an overview of the investigative report for the accusations against Arben Ahmetaj.

According to them, SPAK's investigation against Ahmetaj is politically motivated.

Excerpts from the report:

Arben Ahmetaj served as a deputy of the Assembly of Albania and in several ministerial positions, culminating in 2021 as Deputy Prime Minister and Minister of Finance, until the Special Anti-Corruption Court (SPAK) brought politically motivated charges against him and unjustly removed the MP's immunity. forcing him to seek asylum abroad.

Former United States federal prosecutors and officials who conduct public corruption investigations and prosecutions reviewed and wrote a report on the SPAK case against Mr. Ahmetaj and came to three important conclusions:

There is no corruption

"SPAK's report does not properly define the elements of the accusation of corruption, and SPAK's claims do not link Mr. Ahmetaj to any wrongdoing." [Page 29]
Unreasonable and unsupported conclusions

"We conclude, based on all the evidence available to us, that such conclusions are unreasonable and unsupported by the evidence, and that the conduct of the investigation was deeply flawed. As a result, any resulting prosecution would be fundamentally unwarranted.” [Page 1]

Politically motivated report

"At best, the SPAK report is the result of a weak and mishandled investigation that clearly shows the dangers of entertaining conspiracy theories in criminal prosecutions. At worst, the SPAK report reflects a politically motivated persecution of a high-ranking individual whose only mistake was clashing with the ruling elite." [page 34]

Background in SPAK

The Special Anti-Corruption Courts (SPAK), established in its current form in 2019, adjudicates corruption, organized crime and charges against high-ranking Albanian officials. While the Constitution and Albanian laws prohibit arbitrary detention and arrest, pretrial detention accounts for 52 percent of the prison population.

Millions of dollars are being invested by the US and the international community to strengthen SPAK, and SPAK has played a role in prosecuting some legitimate corruption. However, the case against Mr. Ahmetaj illustrates that the transparency and procedures of the anti-corruption body are still weak.
