As of June 2022, the SP is delaying the issue of Olta Xhaçka's mandate. Meanwhile, the opposition deals with its own problems and no longer mentions it as an issue...  

Prime Minister Edi Rama and the ruling majority seem to have decided not to let Olta Xhaçka fall into the abyss. Although he dismissed her as a minister and gave free rein to SPAK, Prime Minister Edi Rama seems to have decided to protect her as far as the MP's mandate is concerned.

Olta Xhaçka's husband, former deputy Artan Gaçi, was announced by the government as a strategic investor and given land on the coast to build a luxury resort in the South. For the opposition, this is a pure conflict of interest, and in June 2022, it addressed a request to the Assembly, requesting that the mandate of deputy Olta Xhaçka be removed.

The Socialist Party started the maneuvers at that time and after discussions in the Council of Mandates, rejected the opposition's request. But DP appealed to the Constitutional Court and the court slapped the majority. She clearly stated that in such a case, the Assembly serves only as a notary, where it certifies the opposition's request and then passes the case to the Constitutional Court. It is the latter that decides whether or not the mandate should be removed.

But as never before, the SP gave itself the authority to interpret the decision of the Constitutional Court. They convened the Council of Legislation and through various experts came to the conclusion that the Constitution was wrong. After the resistance of the opposition, it was decided that the matter will be referred back to the Mandates Council for discussion. However, there has been no meeting since the summer. It has been 18 months that this case has been kept in the drawer. Even a few days ago, representatives of the Assembly said that they have no plans to include it in the calendar. Lindita Nikolla is the one who leads the Conference of Chairmen and this issue has not been mentioned at all, based on the minutes of the meetings.

Xhaçka threw it away this year as well, as it seems that next year the SP will continue to procrastinate, benefiting from the chaos of the opposition. DP deals with its problems and the revolt in the session, not mentioning this issue anymore. There has been no request to start discussions, unlike what happened a year ago. So in short, even the opposition has seen it as a lost battle. / Pamphlet
