The Deputy of the Democratic Party, Gazment Bardhi, speaking about the issue of the mandate of Olta Xhaçka, said that the Albanian Constitution was made as the Statute of the SP.
Bardhi said that you cannot expect anything from Prime Minister Edi Rama, but added that as a rule, the Assembly is obliged to forward the case to the Constitutional Court.
"The decision of the Constitutional Court for Olta Xhaçka's mandate will have to be implemented and any further delay avoided. In 2022, contrary to the Constitution, the majority decided not to forward the case to the Constitutional Court. Article 70 point 4 of the Constitution is clear that when 1/10 requests to evaluate the incompatibility with the mandate of a deputy, the Assembly is obliged to forward the case to the Constitutional Court.
They rejected the motion of 1/10. The Constitutional Court found this decision unconstitutional and forced the Assembly in January 2023 to forward the file for an in-depth investigation to the Constitutional Court. Today, they came to the Council of Mandates to make a decision, but they could not make a decision.
Rama must have been too busy to answer the phone to gauge what decision they would make. But what happened with the rhetoric of colleagues within the Council was an assassination attempt on the rule of law, because for the first time we heard representatives of the majority saying that the Constitutional Court cannot compel the Assembly.
