The deputy of the Democratic Party, Dashnor Sula, emphasizes that he and the deputies who support Gazment Bardhin do not attack the justice bodies, but in the case of the investigation against the former prime minister Sali Berisha in connection with the privatization of the former Partizani complex, there was a rush to measure safety.
Invited to the "News 24" studio, he said that the Prosecutor's Office and the Court should receive authorization from the Parliament.
" The expression that circulates among jurists is that you will never find two jurists in the same mind. The law always has an interpretation. But as I read the law and without wanting to be influenced by Mr. Berisha, I say that there is a rush from the court on how the law is read. The prosecutor and the judge are guided by the code of criminal or civil procedure. In any kind of court, even in Strasbourg, the first thing a court looks at is due process. If we have a violation of the procedure, it does not go to the core of the case at all, and this happens in every process. In the present case, if it will remain in this status quo, this is striking as a fundamental issue. This rush did not have to happen.
We have declared that we will vote in favor of any kind of request that comes from the Prosecutor's Office. In this case, the Criminal Procedure Code is clear. Banning the passport requires authorization from Parliament. The changes were made in 2012 and we requested that there should be no parliamentary immunity at all. Today, the investigative body has the right to trace the deputy. For the control of the apartment and the measure of security, the Assembly has been bypassed here. I don't know why this was overlooked. The legislator has provided that even in cases where the Parliament does not give authorization, again based on Article 289, the investigative body has the right to continue the investigation ", he emphasized.
He declares that he is against the attacks on SPAK and that the Democratic Party should not be involved in this debate.
"I continue to support the justice bodies and I do not agree with any kind of designation even at the time when Rama attacked SPAK in the SP Assembly. I am against any kind of epithet, any kind of language. I will not be the shield of any politician under any circumstances. If we put it in the political channels, it loses sense and right. There may be certain persons who have vested interests in attacking one politician or another. This does not mean that the entire political force is involved in this debate and in this war. The attitude of Zt. White and ours is that we do not become a shield for any person. If an investigation begins tomorrow about an opposition politician who may have violated the law, then the opposition is never affected and therefore it is important that today's position when he is in the opposition tomorrow is not affected. If Berisha fights for transparency, we must support him ," he said.
When asked if he should include the Democratic Party, deputy Sula was clear: No!
"Sula said that the investigation has also put the prime minister in difficulty. "This is something that has embarrassed Rama himself because it is the first time that a collegial decision, a VKM, is being investigated. What does this mean that this can he will be in charge of his duties tomorrow as well. Then there will be quarrels, it's another thing. Rama is comfortable with this status quo, with Mr. Berisha, with Mr. Meta and Mr. Basha, because he has defeated them several times," he added .
