
The Socialist Party has rejected two opposition requests in Parliament for the establishment of parliamentary investigative committees, namely for the Albanian Road Authority (ARSH) and the National Agency for the Information Society (AKSHI).
The joint request of the Freedom Party and the Democratic Party to establish an investigative commission for the ARA was rejected with 75 votes against and 28 votes in favor.
In a second vote, the Socialist Party also rejected the Democratic Party's request for a parliamentary investigative commission on AKSHI, with 76 votes against and 28 votes in favor.
The two votes confirm the majority's position not to allow the establishment of investigative commissions on these institutions, despite the opposition's demands. This was announced during the plenary session by the Socialist Party itself.
The head of the Socialist Party Parliamentary Group, Taulant Balla, has stated that the SP will vote against this initiative, as according to him, the opposition's request is anti-constitutional. Balla said that the Assembly cannot undertake criminal investigations and that MPs cannot be court prosecutors.
"In fact, Blushi's words were enough to understand that we are not dealing with a request for an Investigative Commission. We are outside parliamentarism, but we are moving towards taking over the powers of other authorities. In our belief, on which we motivate the vote against this request, your request contradicts Mr. Blushi with Article 77 that you cited and this is coupled with the consolidated jurisprudence of the Albanian Constitutional Court and the constitutional practices of the EU Parliaments. In some decisions of the Constitutional Court, the right to investigate is realized only within the function of parliamentary control. The Assembly cannot undertake a criminal investigation. Deputies are neither prosecutors nor judges ," said Balla, among other things.
