Prime Minister Edi Rama convened the Socialist Party parliamentary group today, where the chairman of the Laws Committee, Ulsi Manja, presented the new majority bill, which foresees changes to the Criminal Procedure Code, according to which the Prime Minister and 6 other subjects will be exempt from the measure of suspension from office.
In total, there are 7 subjects involved: the President, the Ombudsman, the Prime Minister, the Deputy Prime Ministers, the ministers, as well as the members of the Constitutional Court and the head of the Supreme Audit Office.
"The article is about prohibitive measures. In point 1, the competence of the court in determining prohibitive measures is clarified, suspension from office, which is a measure that guarantees the investigation and the prohibition of exercising the duty related to the final punishment. We are not at the second, but we are at suspension from office, where it is stated that the measure does not extend to those elected by the electoral law. We propose that in point two, the circle of subjects against whom suspension from office cannot be granted be added. This circle is added with the President, the Ombudsman, the Prime Minister, deputy prime ministers and ministers, members of the Constitutional Court and the chairman of the Supreme Audit Office. From three subjects against whom Article 242 excludes the measure of suspension from office, 7 other subjects are added. We have strictly referred to the Constitution of Albania", said Manja.
Meanwhile, Prime Minister Edi Rama said that the legal changes to prevent courts from suspending ministers and other constitutional positions have no connection to the Balluku case.
On this occasion, the Prime Minister stated that "we will deal with the suspension in order to reject, with the will of the majority in the assembly, the intervention in the costly territory of the executive power." Rama said that no one should think that they have both the stone and the nut in their hands to hit this governing majority.
"The spirit of the Constitution and the basic orientations of the Constitution are not enough, the practices of all the countries that we resemble are not enough, then an article must be made with all the definitions, function by function, so that there is no longer any possibility of interpretation. This is the reason why we are making this change. Whoever connects it to the specific case is making a mistake, the specific case has its own path, it has nothing to do with the suspension. But the suspension is unacceptable, and for this reason we will deal with the suspension to reject, with the will of the majority in the assembly, interference in the territory that is the responsibility of the executive power. No one should think that they have both the stone and the nut in their hands to hit this governing majority. Just as no one should think that this measure, or other measures in the future, have to do with our hesitation to support the independence of justice without reservation", said Rama.
