The request for the implementation of Article 46 calls into question Berisha's mandate and risks taking the clash to court.

The issue of the leader of the DP risks ending up in court again. When Berisha returned as leader, he promised loudly that he would not be like Lulzim Basha, and for this reason, at the assembly held in 2021, he proposed amending Article 46.

This article states: " If, after the announcement of the results of the general elections for the Assembly, the Party does not emerge as the winning governing force, the mandate ends immediately and automatically due to the Statute. In this case, the chairman whose mandate ends is not allowed to run in the subsequent elections for party chairman ."

This change is precisely what risks sinking Sali Berisha. On May 23, the DP holds elections for the mayor and Sali Berisha has decided to run again, not implementing this point of the article with the argument that the elections were stolen. No one within the DP has had the courage to demand the implementation of the statute. Even those who once criticized him are now on their knees.

But reconfirmation as chairman will not be that easy, as the case could end up in court.

The Vice President of the FRPD, Alesia Balliu, has addressed the Presidency of the DP in a letter, requesting the conclusion of the end of Berisha's mandate as president of the DP, after losing the elections of May 11, 2025. The letter states that Berisha has been exercising the duty of president of the DP without a mandate, since September 9, 2025.

Referring to the provisions of Article 46, dubbed by Berisha as the "Basha" article, Balliu says that Flamur Noka should be appointed as the leader of the DP, in the position of the Commander-in-Chief of the DP until the election of the new leader.

" As this provision clearly states, the mandate of the president has ended on 04.09.2025 and since that date, citizen Sali Ram Berisha can no longer exercise the functions of the president of the DPA, as such an action conflicts with an imperative provision of the Statute. In accordance with Article 48 of the Statute, it is the duty of the DPA Presidency, in the absence of the institutional will of the usurper of the position of president of the DPA, to take the necessary institutional actions to establish the legitimacy of the governing bodies of the DPA ," the request states.

Referring to the statute of the Democratic Party, Balliu is not only demanding the end of Berisha's mandate, but also the ban on Berisha's candidacy for the position of mayor in the elections of May 23, 2026.

Her letter states that "any decision-making by Berisha after 04.09.2025 is absolutely invalid and, as such, cannot bring legal consequences as long as the body that took them has not been in function after the end of the mandate". Date 04.09.2025 marks the entry into force of Decision no. 34 of the Regulatory Commission and Decision no. 30 of the Electoral College, which have been recognized and respected even through conclusive actions by the DPA.

But her move is a signal that the case could end up in court. Ervin Salianji himself has warned her several times that the Statute is being violated, while saying that he himself will not put himself at Rama's service to open a legal process.
