The head of the Parliamentary Group of the Socialist Party, Bledi Çuçi, in the Council for Regulation, Mandates and Immunity, speaking also in the capacity of a lawyer, said that the decision of the Constitutional Court on the mandate of Olta Xhaçka creates a vacuum, since this court itself has a conflict in this matter.
While reading the decision of the Constitutional Court, Çuçi said that today we are facing a conflict of constitutional reasoning and that the issue is procedural.
"Are these decisions in force, they are not. Let's find out what the Assembly has not implemented. The debate arises at the point where it is said that the reasoning parts are part of the decision of the Supreme Court. This includes the narrative of the majority on which this decision is based. Today we are in a conflict of constitutional reasoning itself. One party says that the Assembly is obliged to vote as I say. And this is not what the Parliament says. But, some judges, 1/10 think that they should take it to the Constitutional Court and according to them the deputies should vote by compulsion.
On the other hand, we have judges who say that the request of 1/10 of the deputies to request a motion is not binding, it does not force the Assembly to take a decision in a certain form. Since we are in a vacuum to make a decision on this issue, the Assembly does not have a decision today. Since there is a conflict with the CJK itself, I have a question, why do you deny the right of 1/5 of the deputies to address Xhaçka's mandate directly to the Constitutional Court.
We must take it to the plenary session to express the request made by 1/10 of the deputies", said Çuçi.
But Gazmenti Bardhi objected, stating that "now we only have an obligation to implement the decision of the Constitutional Court".
"I didn't understand Chuci's presentation. There is no vacuum, the CJK has said that you have violated the constitution by rejecting the motion of 1/10 of the deputies to forward the request to the Constitutional Court for review.
There is nothing for the council or the Assembly to examine the motion anymore, we have examined the motion and now we only have an obligation to implement the decision of the Constitutional Court. This decision said that our report should be approved.
If you have nothing to hide, your colleague has nothing to hide, the matter goes to be analyzed fundamentally in the GJK and this will be shared by the members of the GJK, whether or not it is incompatible with the implementation of the mandate.
