Veliaj's lawyers have announced an appeal to the Constitutional Court against the President's decree....
President Bajram Begaj's decree to hold partial elections in 6 municipalities has been published in the Official Gazette.
This means that it has already entered into force and all interested parties have the right to appeal to the Constitutional Court.
So, it seems that the way has been opened for the second clash between Edi Rama and Erion Veliaj. Despite the fact that the decree bears Begaj's signature, in fact the fight is between Edi Rama and Erion Veliaj.
The first time, Veliaj appealed to the Constitutional Court and it seems that this gave him some justice, as he accepted the lawsuit and it seemed that he blocked the elections. However, the president interpreted the dismissal differently, stating that it is not based on Article 115 of the Constitution, which gives Veliaj the right to appeal and consequently there is a suspension of the process. According to the Presidency, the act is civil and the appeal can only be made to the Administrative Court.
But with the publication in the Official Gazette, Veliaj has the right to file a second lawsuit, this time appealing the presidential decree and requesting its suspension as far as Tirana is concerned. According to sources, his lawyers have the lawsuit ready, although there is expected to be a debate on whether Veliaj is legitimate as a subject to file a complaint or not.
Article 49 of the Law on the Constitutional Court states: “ The right to initiate a review of the compliance of the law or other normative acts with the Constitution or international agreements is also granted to: b) local government bodies, when they claim that their rights provided for in the Constitution or their constitutional position have been violated .”
Since he has been dismissed, it is debatable whether he still has this right or not. However, the lawyers will file the lawsuit and the ball will be in the court of the Constitutional Court, which must separate the back from the sugar.
With this move, Veliaj challenges Edi Rama for the second time and makes it clear that it will not be so easy to eliminate him politically. / Pamphlet
