The mayor dismissed by the Rama government, Erion Veliaj, will request the Constitutional Court to suspend President Begaj's decree for the November 9 by-elections.
According to the media, Veliaj's lawyers indicate that they will not submit a new request to the Constitutional Court to oppose Begaj's decree, but that another request for lawsuit insurance will be attached to the first request for dismissal.
The mayor's defense will be based on Article 45 of the Law on the Constitutional Court, which states that the Court, ex officio or at the request of a party, may suspend an act when it assesses that its implementation may bring consequences.
The Council of Ministers dismissed Erion Veliaj from office on September 25 at the request of the Tirana Municipal Council. Four days later, the mayor appealed the Government's decision to the Constitutional Court.
Bajram Begaj has decreed November 9th as the date for by-elections in 6 municipalities in the country, including Tirana.
Begaj announced the decree for the by-elections in Tirana when the Constitutional Court has not yet spoken about the "Veliaj" lawsuit.
Initially, the President of the Republic explains that for the vacancy in Tirana, he reviewed the procedure followed by the Tirana Municipal Council and then by the Prime Minister's Office.
Further, President Begaj argues that the Council of Ministers based the decision to dismiss the mayor from office on a special legal provision (the Law on "Local Self-Government") after a 3-month absence from work, which, according to him, differs from the case of dismissal for violation of the Constitution referred to in Article 115.
