It was said that it is urgent, but the issue of clarifying the fate of the missing persons, forcibly abducted by the Serbian police and army, is not being treated as such.
Within 40 days of the adoption in Brussels of the Declaration on the Disappeared, a joint commission should be formed, but such a thing has not happened even after three months, says the chairman of the Governmental Commission for Missing Persons in Kosovo, Andin Hoti .
According to Hoti, Serbia is delaying this process and the European Union should condition it.
Without shedding light on the fate of the missing persons, it makes no sense to continue talks with Serbia, Hoti emphasizes, while mentioning that it has been almost four months since the agreement in Brussels and no steps have been taken to implement the agreement.
He says that the second step after the approval of the declaration was the formation of the joint commission which would have two members of the European Union who would play the role of leaders, as well as two members from Kosovo, two from Serbia, while the International Red Cross would be supportive.
Hoti emphasizes that the EU has all the focus on the events related to the north of Kosovo.
"We had a 40-day deadline, nothing like that happened because I don't have anything official, but I assume it happened because of the north of Kosovo, the problems in the north of Kosovo, the EU directed the focus elsewhere, they asked us some comments about that joint commission, we sent them immediately, last month we were in Brussels for the joint commission, it still hasn't happened, without the establishment of the joint commission we can't continue the work, last month I was exactly to complete the terms of reference and start the work of the joint commission, the joint commission is chaired by the EU not by us, but we still do not have any official response from the European Union. I am still assuming that Serbia has not agreed with any of the points that we have requested, even though they are mostly technical.
The Declaration on Missing Persons was signed on May 2 of this year by the Prime Minister of Kosovo, Albin Kurti, and the President of Serbia, Aleksandër Vucic, at the high-level political meeting in the framework of the dialogue between the two countries.
There, the parties have pledged that they will engage in clarifying the fate of the missing persons.
As long as Serbia does not cooperate in this regard, Hoti says that pressure is no longer enough, but the same should be conditional on its path of integration.
"The EU would have to condition Serbia and not put pressure anymore because Serbia itself, together with Kosovo, have approved a declaration, Serbia itself has also approved the Ohrid annex of this year, and it states the only issue that it's urgent, it's the issue of missing persons, no one else writes that it's urgent, only the issue of missing persons. And if we don't start implementing the issue of missing persons, I don't know what's the point of discussing the dialogue and any something else. Not that it didn't turn out to be urgent, but they started to deal with other issues, which are not in my field, political issues, somehow they forgot about the issue of missing persons, but our work, our duty is continuous to press, to constantly demand, and such is our power,I am thinking about both the EU and Serbia", he emphasizes.
Hoti gjithashtu tregon se muajin e kaluar ishin paraparë dy takime në mes të ekspertëve të Kosovës dhe atyre të Serbisë, por të njëjtat janë anuluar nga pala serbe.
“Muajin e kaluar kemi pasur të paraparë dy takime me delegacionin e Serbisë, ekspertët jo unë, të dyja i ka anuluar Odalloviqi prej Serbisë, me arsyetimin që ai po do të marrë pjesë, ai po do të përfshihet, ju e dini që Qeveria e Kosovës e ka një vendim- ne nuk takohemi me zotin Odalloviq, kështu me këtë arsyetim ai me një formë po do me bë pazare me veten, të kushtëzojë takimet e ekspertëve sepse ekspertët merren me punë hulumtimin e informacioneve, që edhe ai do me marrë pjesë aty ndryshe nuk pranon as me dhënë informacion as asgjë tjetër. I kemi treguar BE-së, por presim reagimin e BE-së dhe unë po shpresoj që brenda këtij muaji apo muajin tjetër do të themelohet komisioni i përbashkët, kjo nuk është në dorën tonë, është në dorën e BE-së dhe çka do të bëjë komisioni i përbashkët, do të mbikëqyrë zbatimin e deklaratës së personave të zhdukur dhe zbatimi i deklaratës së personave të zhdukur”, thotë Hoti.
Hoti thotë se bisedimet me Serbinë do të duhej të vareshin nga çështja e personave të zhdukur, veçmas tani që është një deklaratë e miratuar nga të dy palët.
"Unë si Andin po flas, jo si kryetar i komisionit, besoj që kryeministri nuk ka çka kërkon të vazhdojë negociatat me Serbinë në këtë formë kur ajo nuk pranon në asnjë formë me zbatu as atë që e ka pranu vet që është me urgjencë, që është çështja e personave të pagjetur, që është humane, mendoj që është çështja e parë që ish dashur të merret edhe Kosova, edhe Serbia, edhe BE, edhe çdo kush në botë, sepse është shumë e ndjeshme, zgjidhja e fatit të personave të zhdukur nuk është një çështje që ne po flasim ka ndodhur para 300 viteve e nuk ka pasur teknikë e nuk mund të kryhet, është çështje që ne e dimë që Serbia ka informacionet, ne e dimë kush i ka bërë këto krime”, pohon ai.
Pavarësisht refuzimit të Serbisë për të treguar vendndodhjen e varrezave, ekipet në teren kanë vazhduar gërmimet, çdo herë pas marrjes së urdhëresave për lokacione të shënjuara.
Gërmime janë bërë gjatë kësaj jave në terrorin e komunës së Pejës, por të njëjtat janë mbyllur pa gjetje mortore.
Megjithatë, ekipet do të vazhdojnë trajtimin e dokumenteve dhe në rast se shfaqet ndonjë lokacion tjetër në atë pjesë, gërmimet do të vazhdojnë.
“Informacionet për varreza të reja masive e tjera po shkojnë duke u pakësuar sepse koha po shkon duke u larguar dhe sepse Serbia në asnjë formë nuk po pranon me i dhënë informacionet për personat që i kanë vrarë, i kanë zhdukë apo çfarë kanë bërë, kështu që neve na ka mbetur të hyjmë, të rikthehemi me një formë me ekspertët që i kemi ne të gjitha dokumentet që i ka pasur UNMIK, EULEX, ICTY, në atë kohë t’i rishqyrtojmë edhe njëherë dhe t’i gjejmë gabimet e mundshme që kanë mundur t’i bëjnë ata, sepse institucionet e Kosovës nuk kanë pasur dorë në këto çështje, bile institucionet e Kosovës prej vitit 2018 e kanë çështjen e personave të zhdukur në pronësi të saj, por jemi duke u mundur t’i rikthejmë sepse e kemi parë që ka gabime, natyrisht besoj që pa qëllim por kemi parë gabime edhe në identifikime tradicionale edhe në forma të tjera të gabimeve”, përfundon Hoti.
