Robinho, the former Brazilian soccer star, will remain in prison, where he is serving a 9-year prison sentence.
The Supreme Court in Brazil rejected the appeal for his release on Monday, making the decision by majority vote in a virtual session.
The 41-year-old has been in Tremembé prison, about 150 km from São Paulo, since March 2024. He was convicted of raping a 23-year-old Albanian woman in a Milan nightclub in 2013, when he was playing for Milan. The final decision was given by the Italian Court of Cassation in January 2022.
Although Brazil does not extradite its own citizens, Italian authorities requested that Robinho serve his sentence in his home country, after his return during the trial. His lawyers have appealed several times for his release, but without success. The former footballer himself has denied the charges, calling the decision the result of "racism."
The decision leaves Robinho permanently behind bars, while the former Real Madrid and Milan player will have to serve his sentence in a Brazilian prison.
