The court of Stasburg has given the verdict for Aleks Nika, concluding that there are two violations in this case: the murder and then the failure to solve the murder.
These are violations of two aspects of the right to life, according to the decision of the European Court of Human Rights.
Aleks Nika was killed in the protest of January 21, 2011 on the "Dëshmorët e Kombit" boulevard, along with 3 other protesters. Nika's family sent a lawsuit to the European Court of Human Rights.
Meanwhile, two years ago, the Prosecutor's Office of Tirana reopened the investigation into the murder of Aleks Nika. However, Nika's family members are disappointed by the Albanian justice system, while they have expressed that "the Prosecutor's Office is playing ping pong" with the files. Therefore, they turned to the Strasbourg Court.
Alex Nika is the only one who was shot dead in the protest and no one was held responsible for him.
The protest that ended in tragedy
On January 21, 2011, the socialist opposition called the citizens to protest, after the Meta-Prifti video scandal, where there was talk of a corrupt affair. Protesters gathered in front of the Prime Minister's Office, calling against the then Prime Minister Sali Berisha.
But, when the crowd tried to enter the courtyard of the Prime Minister's Office, the situation became tense and very soon gunshots started from the interior. The bullets left behind four victims: Hekuran Deda, Ziver Veiz, Faik Myrtaj and Aleks Nikaj.
Sali Berisha accused the Socialist Party of wanting to stage a coup. While the opposition accused the Prime Minister and the Minister of the Interior as having ordered the murders.
The first investigation led to Ndrea Prendin and Agim Llupon as defendants for the incident. The court assessed that the murders of Ziver Veiz, Faik Myrtaj and Hekuran Dedaj happened due to carelessness and sentenced the former commander of the Guard, Ndrea Prendi to one year in prison, as well as the guard Agim Llupo to 3 years.
