The appeal requested a retrial in the First Instance Court, but the Supreme Court overturned the decision....
The High Court has overturned the Court of Appeals for the Fier Incinerator. The latter decided in December to return the case to the First Instance for a retrial, but the High Court did not accept. In the Deliberation Chamber, it decided that the case should be retried in the Appeal of the GJKKO, but with a different panel of judges.
" The annulment of decision no. 55 (87-2024-383) dated 19.12.2024 of the Special Court of Appeal for Corruption and Organized Crime, and the return of the case for reconsideration by that court, with another panel of judges, " the Supreme Court informed.
On December 19, the Appeals Court of Kosovo returned the case file for the Fier incinerator for retrial with a different panel of judges. The decision was made by a panel of judges composed of Engert Pellumbi, Miliana Muca and Dhimiter Lara.
On September 25, 2023, the Special Court sentenced former Environment Minister Lefter Koka to 10 years in prison for the Fier incinerator case.
Meanwhile, the former Secretary General of the Ministry of Environment, Bllako, was sentenced to 2 years and 8 months in prison for the charge of "abuse of office of a public official". SPAK also requested in the Appeals Court his sentence for the offense of "abuse of office of a high-ranking state official".
SPAK requested the acquittal of the 3 defendants, which had been given by the first instance, and their conviction. Specifically, Arben Dervishaj, supervisor of the incinerator works, Juri Imeraj, administrator of the JPY company, and Arjola Kodra, Administrator of the Tirana Incinerator. Meanwhile, the lawyers and the defendants themselves requested the acquittal to be upheld.
But the Appeals Court decided to remand the case for a new trial, rejecting any of the parties' requests. But the Supreme Court overturned this decision, requesting that the case be retried by a different panel of judges.
The sentences of the Criminal Court of Kosovo, on September 25, 2023:
-Lefter Koka , former Minister of Environment, has been sentenced to 10 years in prison by the Criminal Court for the Fier incinerator affair, but with a shortened trial he will serve 6 years and 8 months in prison.
-Alqi Bllako , former Secretary General at the Ministry of Environment, former SP MP, has been sentenced to 4 years in prison, but with a shortened trial he will serve 2 years and 8 months in prison.
Klodian Zoto , administrator of the concession company, has been sentenced to 11 years in prison, but with a shortened trial he will be sentenced to 8 years in prison. (On the run)
-Florian Muçaj , member of the concession awarding commission, 3 years in prison, with a shortened trial 2 years in prison! He is released from prison, his sentence has ended
-Erjon Murataj , member of the concession awarding commission, is sentenced to 3 years in prison, will ultimately serve 2 years in prison.
-Azem Shatëri , member of the concession awarding commission, 3 years in prison, with a shortened trial, 2 years in prison! He is released from prison, his sentence has ended
-Loran Dusha , administrator of the Fier Incinerator, has been sentenced to 7 years in prison, he will ultimately serve 4 years and 8 months in prison.
-Arbër Denizi , administrator of PIVOT-04, is sentenced to 7 years in prison, with a shortened trial 4 years and 8 months in prison
4 of them had their sentences commuted to probation.
- Regan Merdani , Administrator of 'Froggy”sh.pk, 3 years in prison (suspended sentence) probation
-Gentian Zifla , Administrator of 'Itneg”sh.pk 3 years in prison (sentence suspended) probation
- Sabina Cenameri , member of the concession awarding commission, 3 years in prison (suspended sentence, has a minor child) probation
-Pellumb Abeshi , former official of the Ministry of Environment, has been sentenced to 3 years and 6 months in prison, with a shortened trial to 2 years and 4 months in prison, ultimately with probation.
They were declared innocent by the Criminal Court.
