Lawyer Arbër Hoxha, speaking about the communication of the charge by SPAK for the former Prime Minister Sali Berisha, said that as of today, the head of the DP is a defendant.

Hoxha said that SPAK raised the charge of passive corruption against the former Prime Minister because the criminal offense of abuse of office is time-barred. Hoxha said that it will be more difficult for SPAK to prove the accusation of passive corruption, but we have the legal handicap, i.e. the fact that "abuse of duty" is prescribed, which forced him to raise the official accusation.

Hoxha said that the reason why SPAK took the most time for the investigations is the fact that the file against Berisha is related to that of the son-in-law, Jamarbër Malltezi.

Explaining the legal procedures, Hoxha said that Mr. Berisha can appeal to the prosecutors that he does not agree with the charge. "SPAK is obliged to return the answer. We have a procedure that starts with a deadline of 10 days, then SPAK takes the file to GJKKO.

I think that within a period of 20-25 days, the preliminary judge should state whether the investigations are complete or not, he can leave other tasks to SPAK, or he can close the case altogether ", said Hoxha.

Next, he said that procedurally within this year we can learn the fate of Mr. Berisha within a year if he enters the summary judgment process.

" If the usual trial takes place, I think that at the end of 2025 we can have a first instance decision-making by the GJKKO ", said Hoxha in 'News24'.

The lawyer said that now are the conditions and circumstances to change the measure of security, as there is no longer any risk that Berisha could spoil the evidence, as long as the investigation is closed and the evidence has been collected.
