The Special Court Against Corruption and Organized Crime (SCOC) has rejected the claims of special prosecutor Altin Dumani and has decided to accept former socialist MP Plarent Ndreca as legal defender of Tirana Mayor Erion Veliaj.
During the hearing, Dumani argued that Ndreca was questioned during the preliminary investigation as a person with knowledge of the case, raising suspicions of a conflict of interest and a risk of invalidity of the process.
On the other hand, Ndreca opposed this position, stating that his testimony is not related to the essence of the case and does not violate the interest of the trial.
In the end, the panel decided not to consider this as a cause of incompatibility and legitimized Ndreca as a lawyer in this process.
Altin Dumani: I stop at Erion Veliaj. It is proven that the defendant has been duly informed and has expressed his will not to participate, requesting to be represented by lawyer Ndreca and that at this stage the proceedings be conducted without his participation. Regarding the lawyer, he was questioned during the preliminary investigation phase of these proceedings and we are in violation of the law in terms of incompatibility, as long as he was questioned as a person who has knowledge.
Altin Dumani: Meriman Palushi remains without a defense attorney, as the lawyer has withdrawn. We are now in a situation where he remains without defense. A lawyer should be appointed primarily for the defendant Palushi. For Ina Goxhaj, information has been received regularly.
Plarent Ndreca: I have a request as a legal obligation. In the assessment of the law, we are not in the conditions of incompatibility. The data of the preliminary investigation do not constitute evidence. I was asked about acquaintances with Veliaj and Xoxa, as well as about the company, if I have any acquaintances, but it does not result. I was asked about a photo that was found in Xoxa's offices, but I had no connection. The statements that I have made are not related to this process and do not violate the interest of the trial. We are not in the conditions of incompatibility.
Altin Dumani: It is your assessment whether you legitimize it. For us, there is no obstacle, but the law must be observed, in order to avoid the possibility of invalidity or reasonable failure. That was our concern.
Ndreca: That is how I commented on it as a concern. But I clarified it and my statements have no mutual interest.
