The decisions of the Strasbourg Court and the Arbitration Courts risk bankrupting the state. The Albanian government has received several slaps from international justice, slaps at a cost of several hundred million euros.
But according to an audit that the High State Control has done in the Ministry of Finance, it turns out that many obligations are not being paid off, significantly burdening the state budget.
According to KLSH, the actual and contingent liabilities for the Strasbourg decisions are presented in the total value of 21,717,665 million Euros, for 7 decisions. It is established that 3 decisions, specifically: D.. against Albania, R. and others against Albania, Sh. Against Albania, which belong to the years 2015, 2016 and 2018, are still unliquidated, contrary to Article 19/4 of Law no. 10018, dated 13.11.2008 "On the State Bar", amended.
KLSH finds that the Ministry of Finance for the case "Sh. against Albania" with letter no. 2554/1 prot., cites that the obligation cannot be borne by the state budget and suggests payment in installments, maintaining a blocking position. As for the case "R. and others against Albania" MFE has not transferred funds to a frozen account, contrary to point 5 of article 19/5 of Law no. 10, dated 13.11.2008 "On the State Bar", amended.

From the audit on the Decisions of the International Court of Arbitration, it results that the total value of the costs of the arbitration decisions paid by the state budget is reported in the amount of 940.25 million ALL.
Meanwhile, from the collection of analytical payments reported in this report, it results that this value is ALL 1,004 million, reflecting inconsistencies in reporting within this report.
“It is established that the reported value of the arbitration costs paid by the MFE apparatus in the above report is about 193 million ALL. While according to the data of the ORACLE system, these payments result in the value of 291 million ALL, or 98 million ALL more", says the report.
According to the SSC, the obligations of the ECtHR and the Arbitration, as well as their non-execution in time, present a fiscal risk, not only for the budget indicators of the responsible institutions but also at the macroeconomic level for public finances, since despite the fact that these obligations are not calculated and not are recorded in public debt indicators, imply and underestimate the latter, as they are obligations that will be repaid in the future.
