KLSH has found that there were abuses with the establishment of criteria for operators related to the construction of the "Art Park". Also, the winning company received additional money by amending the contract in violation of the law...
The High State Control has caught the Minister of Culture Elva Margariti in violation. The institution headed by Arben Shehu has conducted an audit in this ministry with the theme: "On the verification of the procedures followed for the implementation of the project with the object "Art Park and the revitalization and retraining of the territory of the former Cinema Studio "New Albania" carried out by Ministry of Culture".
KLSH has audited the tender developed on this project, where it is a tender with a fund of 155,008,461 ALL without VAT, developed on 15.08.2022, after it was canceled on 21.06.2022.
From the audit, KLSH found that there were abuses with the establishment of criteria for operators. According to KLSH, the qualifying criteria have not been argued and some of them are not proportionate to the implementation capacity, nature and value of the contract.
" The Qualifying Criteria were found to be contrary to VKM no. 425 dated 27.05.2020 "On the procedures for the selection of entities equipped with licenses for design, implementation, supervision and approval in cultural assets, for carrying out Investments with public funds in cultural assets" point 17", states the KLSH.
According to the announcement, point 3.5 requires that the Economic Operator for the realization of the works must have 1 Landscape Architect and 1 Forest Engineer. But this requirement is not in accordance with the nature of the contract, since in the space where the project will be developed, a landscape architect is not necessary, because the project is carried out by the designer and should only be implemented by the bidder through implementing engineers who he has ", says KLSH.
Regarding the request for a forest engineer, it is not necessary and in accordance with the nature of the procurement, because there is no forest outside the Ministry of Culture, but simply a green space.
It is further emphasized that in point 3.7. it is required that the Economic Operator must present a valid license (License, Code III.7.A for "Expertise and/or professional services related to forests and/or pastures"), which is contrary to point 17 of VKM no. 425 dated 27.05.2020 because in the green space of the Ministry of Culture, there are neither forests nor pastures for this criterion to be necessary for the implementation of the procurement procedure.
“Me shkresën e Sekretarit të Përgjithshëm nr. 1055/1, 1055/2, 1055/3 Prot., datë 01.03.2021, u drejtohet operatorëve G.L, G dhe E.K për të paraqitur ofertat e tyre në lidhje me procedurën me objekt "Rivitalizimin dhe përmirësimin e hapësirës së gjelbër" të territorit të ish – Kinostudios Shqipëria e Re. Referuar rregullores së deleguar të BE- së nr. 1268/2, përcaktohet se për fondet deri 300,000 euro pa TVSH, realizohen me procedurë ftesë për ofertë. KVO ka kryer vlerësimin e ofertave në datë 01.04.2021, ku kanë marrë pjesë 3 operator ekonomik me të dhënat si më poshtë: Kontrata për zhvillimit e procedurës me objekt "Rivitalizimin dhe përmirësimin e hapësirës së gjelbër" të territorit të ish – Kinostudios Shqipëria e Re, është një kontratë sipas modelit Lump Sum.
Nga auditimi i dokumentacioneve të vëna në dispozicion të operatorit të shpallur ftues G.L konstatohet: Oferta ekonomike rezulton e pasaktë duke mos vendosur çmimet në të gjitha zërat e preventivit. Rreth 1/3 e zërave të preventivit u mungon oferta e çmimeve përkatëse. Vlera në total e çmimeve të ofertuar në 2/3, rezulton sa vlera e ofertës që është shpallur fitues. Oferta ka rezultuar me gabime dhe të paplotësuara me çmime por nuk është s’kualifikuar nga KVO, për shkak të kontratës çmim total. Nga KVO nuk janë kërkuar sqarime ose argumentime për këtë fakt të cilat më pas kanë sjellë veprime në kundërshtim me kontratën gjatë ekzekutimit të punimeve”, shprehet KLSH.
Po ashtu thuhet se midis Ministrisë së Kulturës dhe operatorit ekonomik "G.L." shpk është lidhur kontrata për punë publike nr. 1962 prot., datë 14.04.2021 me objekt "Rivitalizimi dhe përmirësimi i zonës së gjelbër – Parku i Artit, Ministria e Kulturës" me vlerën e kontratës 356,049 Euro me TVSH.
Me shkresën nr. 20/1 prot., datë 12.04.2022 operatori ekonomik i është drejtuar mbikëqyrësit, ku kërkohen zëra të rinj punimesh me argumentin e mos parashikimit të zërave të nevojshëm në kontratë dhe përmirësime të projektit të propozuar nga kontraktori. Preventivi i rishikuar i punimeve dhe impakti financiar i volumit të shtuar është në masën 15% të vlerës fillestare në vlerën 5,493,869 lekë.
Me amendimin nr. 2, nr. 2147 prot., datë 14.04.2022, nga AK dhe OE, është nënshkruar ndryshimi i kontratës duke rishikuar çmimin dhe rritur vlerën e kontratës në shumën 339,608 Euro pa TVSH ose 407,530 Euro me TVSH dhe afati i përfundimit të punimeve është përcaktuar data 31.05.2022.
