Veting commissioners in the "hall", at the end of the year, remain
Independent Qualification Commission

The members of the KPK have written a letter to the government and the Assembly, asking them not to be without work at the end of the year...

The commissioners of the vetting bodies and their advisers have been caught in trouble. At the end of this year, the re-evaluation process will be closed and the Independent Qualification Commission will be dissolved. (The latter was supposed to be dissolved two years ago, but the deadlines were extended to the end of 2024).

But even though it takes a year until the job is closed, the commissioners have jumped on the attack to grab another job.

The members of the KPK addressed a letter to the Prime Minister, Edi Rama, the Speaker of the Assembly, Lindita Nikolla, the Minister of Justice, Ulsi Manja, the US-EU embassies and the International Monitoring Operation, asking them not to leave them without work.

But so far there is no problem. The interesting thing is that KPK members want to be catapulted to the judiciary and even to the highest level. They claim to have the same status as members of the Supreme Court.

" Given that 2024 is the last year of our mandate, the lack of legal regulation of the status of commissioners after the end of this mandate remains a concern, which brings legal uncertainty and no personal legal guarantee for the members of these constitutional institutions. as the Constitution recognizes them during the exercise of their duties, equating them in status with the member of the Supreme Court. We would like to bring to your attention that the Commission made this official position known in March of this year, together with the Institution of Public Commissioners of the Independent Qualification Commission, we forwarded it as a unified position between the KPK and the Institution of Public Commissioners, as the mandate of the members of these two institutions ends simultaneously on 31.12.2024 ", the letter states, which is accompanied by several legal proposals.

Veting commissioners in the "hall", at the end of the year, remain

The members have made legal proposals both for themselves and for the legal advisors who have assisted them over the years. At the end of the letter, they request that their proposals be considered.

Adhering to the requirements that have been submitted earlier by the Independent Qualification Commission, since 2019-2021, in the spirit of institutional cooperation, please find attached to this letter a broad and well-argued relation to the legal changes that we propose to are initiated by the competent and legislative bodies, part of the 2024 project calendar of the Ministry of Justice, the Council of Ministers and the Assembly of Albania, changes aimed at guaranteeing the status of commissioners, legal unit advisers and the Commission's administrative staff Independent Qualification. With the belief that our legitimate demands will find support, allow me, on behalf of all the members of the Independent Qualification Commission, to express our full will to ensure the successful completion of this historic process for the consolidation of the State of Law in our country and the restoration of public trust in the new institutions of justice ", the letter provided by " Pamphlet " continues .

As for the legal advisers, they are required to be transferred to the National Bureau of Investigation. According to them, they have the experience and ability to exercise this role.

" Following the above analysis, of the professional experience and the special nature of the work performed by the advisers of the Legal Service Unit at the Independent Qualification Commission, it is estimated that this contingent can be naturally involved and offer the acquired expertise also at the institutions that fight corruption and organized crime, such as the National Bureau of Investigation. For this purpose, it is proposed that the advisors, who have a working experience in this position for more than 4 (four) years, with their consent, be appointed as investigators at the National Bureau of Investigation ", the legal proposal states.

So it seems a bit unusual. The commissioners are the ones who decided who stays and who escapes from the judiciary, and they themselves want to enter the system and work with those who qualified them for office. Even advisors from ordinary lawyers now want to go to the BKH, although many competitions have been held to join this body and the current members have passed many tests, even the polygraph. / Pamphlet
