The clash between "Mabco" and "2A Group" for control of the airport escalates on the ground; the government warns of penalties and even the termination of the concession contract
The conflict between the two main shareholders of Vlora International Airport, businessmen Behgjet Pacolli and Valon Ademi, has moved from the courtroom to the construction site, producing scenes of tension and seriously jeopardizing the fate of one of the most important infrastructure projects in the country.
On Monday morning, employees of the company "Mabco Construction", owned by Kosovar businessman Behgjet Pacolli, returned to the airport construction site in Vlora to resume work, just a few hours after Pacolli himself had publicly announced that his company would return to the facility following the recent Supreme Court decision.
But the return was not without incident. According to information from the scene, Mabco employees and their subcontractors were confronted by security guards who attempted to prevent them from entering the airport territory.
The situation quickly became tense. In the midst of verbal and physical confrontations, employees of Pacolli's company forced their way into the construction site, damaging the entrance gate. The conflict then moved to the administrative offices, where they clashed with representatives and employees of the company "2A Group", run by businessman Valon Ademi.
Sources close to the construction site indicate that 2A Group employees left the office premises after the Mabco group entered, while the situation remained tense for several hours. The event marks the culmination of a conflict that has been developing for months between the two parties over the control and administration of the Vlora International Airport project.
A day earlier, Behgjet Pacolli had announced that around 200 employees of his company would return to the construction site to continue the interrupted works.
In his public reaction, Pacolli argued that the reinstatement is based on the Supreme Court's decision, which recently ruled in favor of "Mabco Construction" in the dispute over the administration of the project.
"Vlora Airport should not fall prey to anyone's narrow interests or illegal actions, but should be completed as soon as possible and opened for operation," he declared.
According to the businessman, "Mabco" has invested about 310 million euros in the project and remains committed to completing the work. He insisted that every action of the company is in accordance with the law and with the decisions of judicial bodies.
Në një reagim të mëvonshëm, Pacolli deklaroi se asnjë vendim gjyqësor nuk ndalon hyrjen e “Mabco”-s dhe nënkontraktorëve të saj në kantier. Ai gjithashtu hodhi poshtë deklaratat e bëra nga Bujar Ejupi, duke pretenduar se ai nuk përfaqëson më interesat e shoqërisë VIA.

Përplasja mes Pacollit dhe Ademit ka rrënjë më të hershme dhe lidhet me strukturën aksionare të kompanisë koncesionare “Vlora International Airport” (VIA), e cila po ndërton aeroportin.
Sipas pretendimeve të “2A Group”, palët kishin nënshkruar një kontratë noteriale që do ta rriste pjesëmarrjen e kompanisë së Ademit nga 2 për qind në 49 për qind të aksioneve. Megjithatë, kjo marrëveshje nuk u regjistrua në Qendrën Kombëtare të Biznesit, çka hapi një konflikt të gjatë juridik.
Kompania e Ademit pretendon se më pas “Mabco” vendosi në mënyrë të njëanshme kufizime në funksionimin e shoqërisë dhe regjistroi vendime pa miratimin e organeve përkatëse të VIA-s.
Konflikti u përshkallëzua edhe më tej pas nënshkrimit nga “Mabco” të një marrëveshjeje kredie prej 100 milionë eurosh me fondin financiar “Delphos”. Kjo bëri që “2A Group” të kërkonte pezullimin e administrimit dhe përjashtimin e ortakut nga shoqëria.
Gjykatat e shkallëve më të ulëta në disa raste i dhanë të drejtë pretendimeve të kompanisë së Ademit, ndërsa vendimi i fundit i Gjykatës së Lartë ndryshoi rrjedhën e çështjes, duke rikthyer kontrollin e projektit tek “Mabco”.
Përveç betejës civile, çështja ka marrë edhe dimension penal. Prokuroria e Tiranës ka nisur hetime ndaj biznesmenit Behgjet Pacolli dhe personave të lidhur me të për veprat penale të mashtrimit me pasoja të rënda, mashtrimit kompjuterik dhe falsifikimit të dokumenteve dhe akteve.
Hetimet janë ende në fazë paraprake dhe deri më tani nuk ka një vendim gjyqësor përfundimtar mbi këto akuza.
Ndërkohë, qeveria shqiptare ka shprehur shqetësim të hapur për situatën e krijuar. Ministri i Infrastrukturës dhe Energjisë, Enea Karakaçi, deklaroi se konflikti mes aksionerëve po mban peng një investim strategjik për vendin dhe po vonon funksionimin e aeroportit.
“Mosoperimi ose bllokimi i tij nuk është thjesht çështje biznesi privat. Është çështje e interesit publik dhe shtetëror”, deklaroi ministri. Sipas tij, çdo ditë vonesë sjell humbje ekonomike për industrinë e turizmit, operatorët ekonomikë, komunitetin lokal dhe buxhetin e shtetit.
Karakaçi paralajmëroi se Ministria do të zbatojë të gjitha klauzolat e kontratës koncesionare, duke filluar nga vendosja e penaliteteve financiare e deri te mundësia e zgjidhjes së njëanshme të kontratës, nëse situata vazhdon.
Aeroporti Ndërkombëtar i Vlorës konsiderohet një nga projektet më të rëndësishme infrastrukturore në jug të vendit dhe ishte parashikuar të niste operimet që në muajin mars të këtij viti.
