The use of mobile phones as a source of evidence in criminal investigations has been the focus of a discussion at the High Prosecutorial Council. The Head of the Special Anti-Corruption Prosecution Office (SPAK), Klodian Braho, was asked about the great importance that these devices have in investigative processes and the procedures that are followed for data management.

One of the members of the High Prosecutorial Council has raised concerns about the dependence of investigations on mobile phone data.

"Why is all of SPAK's activity related to seizing cell phones?" he asks.

This question highlights the high rate of use of these devices as evidence, which according to the discussion amounts to about 75% of the total.

The head of SPAK, Klodian Braho, has argued that the importance of mobile phones is related to their widespread use in everyday life and the potential to contain data relevant to investigations.

"Cell phones are the most useful items. With the release of the Constitutional Court's decision, SPAK has changed the procedure for examining and obtaining cell phone data, prosecutors are also turning to the court to obtain and use data from cell phones. Although there is still no legal change in the procedure regarding the procedure that must be followed, the CC's decision has begun to be implemented as far as we think it is applicable. SPAK has also set up a working group to regulate the situation from a legal perspective. We expect the court's practice to develop a little more," he said.
