SPAK finds no evidence of Zaganjori's concealment of assets...
After months of investigations into the concealment of assets, the Special Prosecution Office has decided not to prosecute the former President of the Supreme Court, Xhezair Zaganjori. The SPAK's request to discontinue the criminal proceedings against him has been accepted by the Special Court against Corruption and Organized Crime (GJKKO), with the argument that "the criminal fact does not exist."
The decision was made by Judge Erjon Bani, who signed the closure of file no. 137, as the investigation did not find sufficient evidence to justify filing a charge of concealment or false declaration of assets. This development comes several years after Zaganjori was dismissed from office for the same reason during the vetting process.
Xhezair Zaganjori headed the High Court until 2019, when he was dismissed by the Special Appeals Chamber following a recommendation from the ONM. Although the Independent Qualifications Commission had initially confirmed him in office, the Public Commissioner appealed the decision, stating that Zaganjori had significant problems justifying his and his family's assets.
The KPA noted discrepancies in the declarations about a house, shop, garage and a library owned by him, as well as doubts about payments for the education of children abroad. The rapporteur of the case, Albana Shtylla, stated in the hearing that "the subject Zaganjori has made incorrect declarations and does not justify the sources".
Despite these vetting findings, SPAK has failed to gather criminal evidence to support a viable charge in court. With this decision, the former magistrate escapes criminal prosecution, but remains outside the system.
