SPAK has closed the investigations for the sterilization concession and has sent the file for trial to GJKKO.
The Special Prosecutor's Office against Corruption and Organized Crime has closed the investigations and brought the former Minister of Health, Ilir Beqaj, his former deputy, Klodian Rjepaj and the other accused persons to trial.
Also, the charges have been determined for everyone, as well as the involvement in the corrupt scheme.
Charges:
The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has completed the preliminary investigations and submitted to the Special Court of First Instance for Corruption and Organized Crime the request for trial of criminal proceedings no. 13 of 2020, in charge of the defendants:
1. Ilir Beqaj, accused of committing the criminal offense of "Abuse of duty", carried out in collaboration, provided by articles 248 - 25, of the Criminal Code;
2. Klodian Rjepaj, accused of committing the criminal offenses of "Fraud", committed in collaboration, with serious consequences, "Forgery of documents", committed in collaboration, "Abuse of duty", committed in collaboration, provided by articles 143/2, 3, 186/3-25 and 248-25, of the Criminal Code.
3. Ilir Rrapaj, accused of committing the criminal offense of "Fraud", committed in collaboration, with serious consequences, provided by article 143/2, 3, of the Criminal Code.
4. Marsela Serjani, accused of committing the criminal offenses of "Forgery of documents", committed in collaboration and "Abuse of duty", committed in collaboration, provided by articles 186/3 - 25 and 248 - 25, of Criminal Code.
5. Saimir Kadiu, accused of committing the criminal offenses of "Forgery of documents", committed in collaboration and "Abuse of duty", committed in collaboration, provided by articles 186/3 - 25 and 248 - 25, of the Criminal Code.
6. Petref Mersini, accused of committing the criminal offenses of "Forgery of documents", committed in collaboration and "Abuse of duty", committed in collaboration, provided by articles 186/3 - 25 and 248 - 25 of the Code Criminal.
7. Arben Gjata, accused of committing the criminal offenses of "Forgery of documents", committed in collaboration and "Abuse of duty", committed in collaboration, provided by articles 186/3 - 25 and 248 - 25, of Criminal Code.
8. Genc Burazeri, accused of committing the criminal offenses of "Forgery of documents", committed in collaboration and "Abuse of duty", committed in collaboration, provided by articles 186/3 - 25 and 248 - 25 of the Code Criminal.
9. Naile Ajazi, accused of committing the criminal offenses of "Forgery of documents", committed in collaboration and "Abuse of duty", committed in collaboration, provided by articles 186/3 - 25 and 248 - 25, of Criminal Code.
Criminal proceedings no. 13, was registered on 13.01.2020, for the criminal offenses of "Abuse of duty", committed in cooperation, provided by article 248-25 of the Criminal Code, of "Violation of the equality of participants in tenders or auctions public" , carried out in cooperation, provided by article 258-25 of the Criminal Code, "Passive corruption of high state officials or local elected officials", provided by article 260 of the Criminal Code, in relation to the concession awarding procedure "For integrated services for the provision of a personalized set of surgical instruments, the supply of disposable sterile medical material in surgical rooms, as well as the treatment of biological waste and the disinfection of surgical rooms", from the Ministry of Health.
After the registration of the criminal proceedings, the prosecuting body carried out an extremely large number of investigative actions, the analysis of which proved that the former Deputy Minister of Health Klodian Rjepaj, in the capacity of the Chairman of the Concession Granting Commission, is the person who performed all financial calculation actions. He has changed these financial data several times, until reaching those approved by the Concession Granting Commission. These changes were made in order to achieve the financial indicators IRR and NPV, at levels accepted by the Ministry of Finance, in function of the approval of the project by the Ministry of Finance. In the actions of financial calculations, it is fully proven that the number of surgical interventions was falsely reported in these documents, which were presented to the Ministry of Finance.
Gjithashtu në këta tregues financiar, me qëllim uljen e normës së IRR dhe NPV, i pandehuri Klodian Rjepaj, ka shtuar si zëra të kostove të shërbimit në kohëzgjatjen e koncensionit, mirëmbajtje të instrumenteve, të sistemeve dhe centralit të sterilizimit, në vlera disa herë më të larta se vlera e blerjes së tyre të reja. Gjithashtu në Krahasuesin e Sektorit Publik, si treguesi kryesor për dhënien e këtij projekti me Koncension/Partneritet Publik Privat, janë përdorur kosto të rreme të këtij shërbimi në QSUT për vitin 2013, duke vendosur vlerat e barnave dhe medikamenteve mjekësore, që nuk janë pjesë e këtij shërbimi. Kjo kosto është rritur dhe mbivlerësuar në mënyrë të rreme në masën 56.4%. Gjatë gjithë periudhës përgatitore të projektit, procedurën e tenderimit dhe dhënies së koncensionit deri në firmosjen e kontratës koncensionare, i pandehuri Klodian Rjepaj ka bashkëpunuar ngushtësisht me te pandehurin Ilir Rrapaj, me qëllim shpalljen fitues të operatorëve ekonomikë, ku pjesëmarrës është me 40% subjekti tregtar “Investital Llc”, me përfaqësues po të pandehurin Ilir Rrapaj.
Për këto veprime, të pandehurit Klodian Rjepaj dhe Ilir Rrapaj, provohet se kanë konsumuar elementët e veprës penale të “Mashtrimit”, e kryer në bashkëpunim dhe me pasoja të rënda, të parashikuara si vepra penale nga nenet 143/2, 3, të K.Penal.
Ish Zëvëndësministri i Shëndetësisë Klodian Rjepaj, në cilësinë e Kryetarit të Komisionit të Dhënies së Koncensionit, si personi i cili ka bërë pasqyrat financiare dhe studimin e fizibilitetit, në bashkëpunim me anëtarët e tjerë të komisionit Marsela Serjani, Petro Mersini, Arben Gjata, Saimir Kadiu, Genc Burazeri dhe Naile Ajazi, për të gjitha veprimet ose mosverpimet e sipërcituara, provohet plotësisht se kanë konsumuar elementët e veprave penale të “Falsifikimit të dokumentave”, e kryer në bashkëpunim dhe “Shpërdorimit të detyrës” e kryer në bashkëpunim, të parashikuara nga nenet 186/3 – 25 dhe dhe 248 – 25 të Kodit Penal, pasi me veprime aktive, kanë ligjësuar këta dokumente me të dhëna të pavërteta.
Për veprimet ose mosveprimet që kanë të bëjnë me miratimin dhe nënshkrimin e kësaj kontrate koncensionare, duke i miratuar ato në kundërshtim me rregullat dhe aktet ligjore e nënligjore të zbatueshme për konçesionet, rezulton e provuar plotësisht, se ish Ministri i Shëndetësisë, i pandehuri Ilir Beqaj, ka konsumuar elementët e veprës penale të “Shpërdorimit të detyrës”, e kryer në bashkëpunim, me Klodjan Rjepajn, të parashikuara nga 248 -25, të Kodit Penal.
Gjithashtu, në kuadër të këtij procedimi penal është proceduar me caktimin e masës së sigurimit pasuror sekuestro preventive, vendosur me vendimin nr. 46, datë 22.01.2024, të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar, për pjesën takuese prej 40 % të Shoqërisë “Sani Servicve” Sh.p.k.; Shoqërinë ‘Globalsher’ Sh.p.k. dhe asetet e saj, me ortak të vetëm të pandehurin Ilir Rapaj.
At the National Business Center, the seizure of 40% of the shares of the company "Sani Service" Sh.pk. Specifically, the quota belonging to the commercial entity "Investital Llc", represented by the defendant Ilir Rrapaj, as well as the seizure of 100% of the quotas of the company "Globalsher" sh.pk, making the corresponding entries in the Historical Extract of the Register Merchant, for the above company.
The bank accounts of the entity "Globalsher" sh.pk were also seized, an account in the amount of 285,412.48 Euros and an account with a balance of 113,610.93 Lek (the account was in a second level bank).
13 (thirteen) vehicles belonging to the company "Globalsher" sh.pk were seized, of which 3 were rented and 9 owned by this company, as well as a real estate 2+1 apartment, owned by the company "Globalsher" sh.pk, in the city of Vlora.
Investigations continue within the framework of separate criminal proceedings no. 13/1, of 2020, related to suspicions of actions in violation of the law by persons subject to the investigation of this prosecution during the execution phase of the concession contract, etc.
