On September 25, the Special Court Against Corruption and Organized Crime announced the decision on the Fier incinerator case. According to the decision, former Minister of Environment Lefter Koka was sentenced to 6.8 years of imprisonment, Klodian Zoto was sentenced to 8 years, while for the other defendants the decisions ranged from a declaration of innocence to 4 years in prison.
The punishment measures on the officials and defendants in this case received all the attention of the media and public opinion. But the decision has another very important point, which passed in silence. The acquittal and the removal of the seizure of the entity Integrated Technology Services, i.e. Klodian Zoto's company.

In relation to the accusations that the prosecution brought against the ITS company, the Special Court has decided:
1-The not guilty declaration of the defendant, the commercial company "Integrated Technology Services" sh.pk, accused of committing the criminal offense "Active corruption of high state officials or local elected officials";
2-The not guilty declaration of the defendant, the commercial company "Integrated Technology Services" sh.pk, accused of committing the criminal offense "Cleaning the proceeds of a criminal offense or criminal activity";
3-The not guilty declaration of the defendant, the commercial company "Integrated Technology Services" sh.pk, accused of committing the criminal offense "Fraud", with serious consequences";
After freeing the company from all charges, the Special Court also decided to return the properties, which had been seized by SPAK, a seizure which it had approved itself in March of last year.
"Based on articles 389 and 275 of the Code of Criminal Procedure, the removal of the property security measure "Preventive Sequestration", imposed on the legal entity, the trading company "Integrated Technology Services," the decision states.
A scapegoat and a precedent?
ITS is the company owned by Klodian Zoto. This company is a 70 percent shareholder in the ITÔS company, which has the concession of the Fier incinerator. The remaining 30 percent is owned by a company called Patos Construction-Montime, which has now changed its name.
In addition to owning 70 percent of the shares of the Fier concession company, ITS has also been its main subcontractor. So the money went from the budget to ITA. Afterwards, the concessionaire company subcontracted works to ITS and the latter to other entities, including the fictitious ones that were convicted for the evasion scheme.
The fictitious companies for which the court convicted the former Minister of Environment Lefter Koka for corruption received the money precisely from ITS. According to SPAK's investigation, ITS was the pivot of the scheme that made the fictitious payments and channeled the alleged bribes.
But despite this, through the decision, the court has freed ITS from all charges, even returning to it all the properties seized by SPAK to Zoto's company, even though the latter was found guilty of corruption.
If ITS, the company that managed all the money of the Fier incinerator and made payments to fictitious entities, which the Court itself says were bribe evasion and channeling, is declared innocent, why is Lefter Koka kept in prison and why was he sentenced to 6.8 years?
If ITS is innocent as the court says in the decision, who bribed the former minister of environment and other high officials? And finally, is the incinerator issue ending in a farce with predetermined scapegoats?
Or worse yet, is the decision for Fier preceding that of the Tirana incinerator? So the precedent is clear. Administrators and paper owners can be punished, but the concession must continue./ Capital
