Greece/ Abused EU funds, European Public Prosecutor's Office files charges

The European Public Prosecutor's Office (EPPO) in Athens has filed criminal charges against 22 people, including four sitting MPs, former public officials and political associates, as part of investigations into an alleged fraud scheme in the management of agricultural funds through the Greek Organisation for Payments and Control of Community Aid (OPEKEPE).

According to the EPPO announcement, the charges against seven other sitting MPs have been dropped due to lack of sufficient evidence. The institution has not made public the names of the MPs involved.

The investigation relates to suspected actions committed during 2021. On April 24, the Greek Parliament approved the European Public Prosecutor's request to lift the parliamentary immunity of 11 MPs, paving the way for the continuation of the investigations.

According to the EPPO, investigations have uncovered repeated corrupt practices in the administration of Common Agricultural Policy (CAP) subsidies. The findings include unlawful interference with administrative and control procedures, retroactive changes to data after mandatory checks have been completed, manipulation of on-the-spot checks, concealment or alteration of inspection results, and the use of false certificates.

In the same case, the EPPO has also brought charges against the former president of OPEKEPE for five alleged acts of breach of trust, against the former director of the Direct Assistance Directorate for two similar charges, as well as against two former regional directors of the institution for breach of trust and unlawful management of European Union funds.

Of the four charged MPs, three are suspected of inciting breach of trust, while the fourth is accused of inciting the embezzlement of European funds. The latter also faces additional charges of inciting false statements and attempted fraud.

Under Greek law, if found guilty, the defendants could be sentenced to up to five years in prison, as well as fines as provided for by law. The EPPO emphasizes that all defendants are presumed innocent until a final court decision.

The European Public Prosecutor's Office also announced that investigations continue for other persons involved in the OPEKEPE case, including three former MPs. In parallel, other investigations are underway into suspected cases related to this scandal, carried out at different times, without providing further details in order not to prejudice the progress of the investigative procedures.
