A 42-year-old man, who has been imprisoned for 20 years for a murder committed in the village of Shijan, Delvina, for which he was sentenced to life imprisonment, is continuing his legal battles to gain freedom. After receiving the rejection of the Strasbourg Court in March 2024, from the high-security prison in Drenvoë, Durim Leka is seeking conditional release.

On October 16, 2025, Durim Leka's request for "parole" was registered at the Koça Court. The hearing is scheduled for November 17, when Judge Estjon Venxha is expected to review the request of the person sentenced to life imprisonment by the Saranda Court. Leka has previously also requested a reduction in sentence from the same Court, the decision of which is not known.

The 42-year-old, born in Pogradec and residing in the village of Blerimas, Delvina, has been sentenced by all levels of the judiciary to life imprisonment, the case, which was also reviewed by the Strasbourg Court a year ago.

The incident for which Leka is accused occurred when he was 22 years old and working as a bricklayer. On August 23, 2005, the money changer Agim Sulo was shot to death in Shijan, Delvina. His brother Pëllumb Sulo, who was present and who was also shot at, but was not hit, immediately went to the police and reported the crime. That same day, the police inspected the scene and found two shell casings on the ground. During the search that was carried out the next day, the police found another shell casing. On August 23 and 24, 2005, the police questioned Leka to establish his relationship with Agim Sulo, because a note with Leka's phone number was found on the latter. At the time of the interrogation, Leka was not yet a suspect and he did not make any incriminating statements during the questioning. He was only asked if he knew Agim and Pëllumb Sulon and he replied that he did not know them.

On 24 August 2005, the prosecution, as an urgent secret wiretapping measure, installed a listening device in the waiting room of the Saranda police and obtained a recording of the conversation between the applicant and his brother N. Leka, which revealed that the suspect had told him that he had killed Agim Sulo and had then gone to Saranda, where he had gone out to sea in a boat and had thrown the gun in the direction of the “Grand Hotel” in Saranda. The prosecution then requested the Saranda District Court to validate the secret wiretapping measure, which was approved on 28 August 2005. The police arrested Durim Leka on 27 August 2005 and he was questioned by the prosecutors on the same day.

Sulo kishte mbërritur me motorr me vëllanë e tij Pëllumbin. Vrasësi u kishte thënë se nuk i kishte paratë me vete, por ata duhej të shkonin në shtëpinë e tij. Ai i kishte çuar në një shtëpi të braktisur dhe, kur kishin mbërritur atje, Leka kishte nxjerrë armën dhe i kishte kërkuar paratë Sulos. Kambisti po shkonte drejt vrasësit kur ai nxori armën dhe qëlloi. Vëllai tij filloi të vraponte dhe leka qëlloi dy herë në drejtim të tij, por nuk e kapi. Ambulanca mbërriti shpejt, por kambisti Sulo vdiq rrugës për në spital. Po atë ditë, në orën 18.00, u zhvillua një paraqitje për njohje ku, përveç Durim Lekës, ishin paraqitur edhe dy persona të tjerë. Leka kishte veshur një këmishë të errët me mëngë të gjata, ndërsa dy personat e tjerë të paraqitur për njohje mbanin veshur këmisha të bardha me mëngë të shkurtra. Pëllumb Sulo, si dëshmitar, u ftua fillimisht të përshkruante personin që kishte qëlluar vëllanë e tij. Në fillim ai bëri një përshkrim të hollësishëm të personit, 1,70 m i gjatë, i hollë, me fytyrë të gjatë, kuqalash me quka në faqe, vetulla kafe në të verdhë, flokë bionde të errët, zë të hollë, të folur të pastër, pa asnjë dialekt. Gjatë paraqitjes për njohje, pjesëmarrësve iu kërkua të ndërronin vendet tri herë. Çdo herë, Pëllumb Sulo identifikoi Durim Lekën si autorin e krimit.

An expert report dated 30 August 2005 drawn up by the Central Criminal Investigation Laboratory concluded that the two cartridges had come from a firearm, namely a T. T model 54 pistol. The weapon was never found. Leka was questioned again by the prosecutor on 14 and 22 September 2005. The minutes of the questioning state that Leka was informed of his right to be assisted by a lawyer. He stated that he had been informed of the charges and that he would make the statement without a lawyer and that he would decide later whether to have a lawyer. He signed the minutes without any comment. On 14 September 2005 the applicant explained that he had taken a pedal boat from Saranda to the sea and had thrown the weapon into the sea in the direction of the “Grand Hotel” in Saranda. In a decision dated December 9, 2005, the Saranda District Court found Durim Leka guilty of murdering two or more persons in other aggravating circumstances and attempted murder of a person and illegal possession of weapons and sentenced him to life imprisonment.

On April 5, 2006, the Gjirokastra Court of Appeals amended the charges and found Leka guilty of attempted robbery resulting in death, where Agim Sulo was the victim, as well as of attempted murder of Pëllumb Sulo with the intention of committing another crime, as well as of illegal possession of weapons, and upheld his sentence of life imprisonment.

Leka's subsequent appeal to the Supreme Court was ultimately dismissed. He then filed a constitutional complaint, which was dismissed on 19 May 2009. Leka went all the way to the Strasbourg Court, which decided on 5 March 2024 to declare the application admissible, but without changing its decision as it found no violation of Article 6 § 1 and 3 (a), (b) and (c) of the Convention.
